Can I sell my Arlington house before foreclosure?
Our agreement of sale will often get a trustee's sale postponed so we can close. Signing alone doesn't postpone it automatically; we use the agreement to ask for the postponement, and it works more often than people think.
If your Arlington County home is facing a Virginia mortgage foreclosure, selling may still be an option if the sale closes and pays off the loan before the trustee's sale. Do not count on buying the house back after the sale. USA Home Buyers buys houses as-is in Arlington, Virginia (Arlington County). We buy houses as-is, in any condition — no repairs, no cleaning, no cleanout required to sell to us.

How we help before a trustee sale
We review the house as-is and work toward a closing through a title company. You get a written offer and written terms before you commit. If a trustee's sale is scheduled, our agreement gives us something to use when asking for time to close:
Our agreement of sale will often get a trustee's sale postponed so we can close. Signing alone doesn't postpone it automatically; we use the agreement to ask for the postponement, and it works more often than people think.
The loan still needs to be paid off as part of a sale before the trustee's sale. Have the title company or an attorney confirm the current sale date and payoff; do not assume the date has moved because an agreement was signed.
Which sale is on your notice?
A Virginia mortgage foreclosure is usually a trustee's sale under a deed of trust: the trustee auctions the house without a court case. For an owner-occupied home, written notice of the sale generally must go to the owner at least 60 days ahead; for other property, the notice period is 14 days. The sale must also be advertised in a local newspaper. Check the notice for your property and confirm the current date.
Plan to close and pay off the loan before the trustee's sale; do not count on buying the house back afterward. A trustee can postpone a sale, but a postponed sale must be advertised again. Do not assume the date has changed; confirm it with the trustee or title company.
A notice about unpaid real-estate taxes is not the mortgage trustee's sale described here. It has its own date and instructions. Do not apply the mortgage notice periods to a tax-sale notice; follow that notice and contact the office named there.
Virginia's trustee-sale notice, advertising and postponement rules are in Va. Code §55.1-320, §55.1-321, and §55.1-322. The current notice and sale record control the date for your property.
If the payoff is the problem
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.
Ask your lender for the current payoff amount. The title company can review it with the title and lien information for your property.

What happens next
- Contact us by phone or form and share the property address and any sale notice.
- We give you a written cash offer and written terms before you decide whether to sell.
- If you choose to proceed, the title company checks title and gets payoff information, including any liens and back taxes that apply.
- The title company handles closing. When you sell to us, we pay the closing costs, including Virginia state and local recordation taxes, grantor tax and any applicable regional WMATA capital fee, regional congestion relief fee or regional transportation improvement fee. Your mortgage payoff, liens, back taxes and share of current property taxes are separate from that closing-cost promise.
It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.
Arlington County offices and information
For questions about an Arlington County real-estate tax bill, use the County Treasurer's Real Estate Taxes and Payments page. If your notice is for a trustee's sale, check the trustee's current notice and newspaper advertisement instead; the County tax page does not confirm that sale date.
For recorded deed and land-record questions, the Arlington County Circuit Court Land Records Division provides the county's official information. It is not a trustee-sale schedule; confirm any active sale date with the trustee or title company.

Foreclosure questions in Arlington, Virginia
Can I sell my Arlington house before a Virginia trustee sale?
Our agreement of sale will often get a trustee's sale postponed so we can close. Signing alone doesn't postpone it automatically; we use the agreement to ask for the postponement, and it works more often than people think. A sale may still be possible if it closes and pays off the loan before the trustee's sale.
How much notice comes before a Virginia trustee sale?
For an owner-occupied home, written notice of the sale generally must go to the owner at least 60 days ahead; for other property, the period is 14 days. The sale must also be advertised in a local newspaper. Check the notice and current sale information for your property.
Is a mortgage foreclosure the same as an Arlington property-tax sale?
No. A mortgage trustee sale under a deed of trust is different from a sale notice about unpaid real-estate taxes, and the tax notice has its own date and instructions. Do not use the 60- or 14-day mortgage notice periods to work out a tax-sale deadline; contact the office named on that notice. For Arlington County real-estate-tax questions, use the County Treasurer’s official tax page.
What if the mortgage payoff is more than my house is worth?
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before. The current payoff and title details still need to be reviewed for your property.
Do I have to pay back taxes or liens before closing?
You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront. A sale agreement does not automatically change a separate tax-sale date, so follow the instructions on that notice.
Do I need to repair or clean out the house before selling to you?
We buy houses as-is, in any condition — no repairs, no cleaning, no cleanout required to sell to us.
