Can I Sell My Cleveland House Before Foreclosure?
If a trustee's sale is scheduled, tell us the date right away so we can try to close before it.
Often, yes, if a sale can close before the scheduled trustee auction and the payoff, title, and other closing requirements can be met. Many Tennessee home loans use a deed of trust; when it includes a power of sale, the trustee can sell the house at public auction without a court case. A court-ordered sale follows different rules.

How we help you work toward closing
We review the house as it stands and work from the sale date, payoff, title, and property details. You do not need to repair, clean, or clear out the house to sell it to us. We give you a written cash offer and written terms before you commit; if you choose to proceed, closing is through a title company.
When you sell to us, we pay the closing costs, including Tennessee's realty transfer tax. Your mortgage payoff, liens, back taxes, and share of current property taxes are separate.
Which sale is involved?
A mortgage foreclosure concerns the home loan. A property-tax sale concerns unpaid property taxes. They are separate processes with separate notices, offices, and deadlines. Do not use a mortgage trustee-sale date or notice period to work out a property-tax sale deadline. Follow the tax notice and contact the office or court named there.
The Bradley County Trustee is a local starting point for county property-tax questions; it is not the mortgage trustee named in a home-loan sale notice. A county tax-account page is not a mortgage-sale schedule or a tax-sale calendar.
Tennessee mortgage foreclosure notices and sale dates
Many Tennessee home loans use a deed of trust. When it gives the trustee a power of sale, the trustee can sell the house at public auction without a court case. Under the usual notice rules in effect since July 1, 2025, the sale notice must run at least twice in a newspaper published in the county, with the first newspaper notice at least 20 days before the sale. The notice must also be posted online by a third-party internet posting company for at least 20 days in a row. The trustee must mail you a copy by registered or certified mail by the date of the first newspaper notice.
Unless the loan papers forbid it, the sale can be postponed one or more times without a new newspaper notice, but it must still happen within one year of the original date. Each new date must be announced at the scheduled sale and posted online, unless the delay is less than five days. If the sale is pushed back more than 30 days, the new date, time, and place must be mailed to you at least 10 days beforehand. Check the current date with the trustee named in your notice; do not assume a postponement changed it.
For a sale under a deed of trust or mortgage without a court judgment, Tennessee law provides a two-year right to redeem after the sale unless the loan document expressly waives it. A court-ordered sale has different rules. This is an after-sale right, not extra time to close before the sale.

If the payoff is the problem
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.
Ask the lender for a current payoff statement. If you choose to proceed, the title company can review the confirmed payoff and other title details for closing.
You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront.
When you sell to us, we pay the closing costs, including Tennessee's realty transfer tax. Mortgage payoffs, liens, back taxes, and your share of current property taxes are separate from that promise.

What happens next
- Call or send the Cleveland property address and the sale date shown on your notice.
- We review the house as-is and give you a written cash offer and written terms before you commit.
- If you choose to proceed, a title company checks title and works through the confirmed payoff and other closing details.
- The title company handles the closing work if the sale is ready to proceed.
It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.
Local office and official sale information
For a mortgage trustee sale, check the current date and instructions on your notice and contact the trustee named there. The Secretary of State list links to third-party internet posting companies used for trustee-sale notices; it is not a county sale calendar. For a Bradley County property-tax question, use the County Trustee's official page. If a tax sale is involved, confirm its date and next steps with the office or court named on that notice.

Under the usual rules in effect since July 1, 2025, notice must run at least twice in a newspaper published in the county, with the first newspaper notice at least 20 days before the sale. It must also be posted online for at least 20 consecutive days, and the trustee must mail you a copy by registered or certified mail by the first newspaper notice. Is a property-tax sale the same as a mortgage foreclosure sale?
No. Mortgage foreclosure concerns a home loan; a property-tax sale concerns unpaid property taxes. The notices, offices, and deadlines are separate. Do not use a mortgage trustee-sale notice period to work out a tax-sale deadline; follow the tax notice and contact the office or court named there.
What if the mortgage payoff is more than my Cleveland house is worth?
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before. Ask the lender for a current payoff so the title and closing figures can be reviewed.
Can Tennessee give me time to redeem after a trustee sale?
For a sale under a deed of trust or mortgage without a court judgment, Tennessee law provides a two-year right to redeem after the sale unless the loan document expressly waives it. A court-ordered sale has different rules. This is an after-sale right, not extra time to close before the sale.
What happens after I contact USA Home Buyers?
We review the house as-is and give you a written cash offer and written terms before you commit. If you choose to proceed, a title company reviews title and payoff details and handles the closing work. Whether a sale can close before a scheduled date depends on the actual notice, payoff, title, and timing.
Testimonials are real, from our transactions, verified and approved by our attorneys. Review locations identify where each seller was based; a review from another market is not a Cleveland transaction.
