Grand Island, NE / Foreclosure
Can I Sell My Grand Island House in Foreclosure?
If a trustee's sale is scheduled, tell us the date right away so we can try to close before it. Often, yes: you may be able to sell before a Nebraska foreclosure sale if the payoff, title work, required court steps, and closing can be completed in time. A trust-deed foreclosure and a mortgage foreclosure follow different procedures.

How we help with a Grand Island foreclosure sale
We review the house and the notice with you, then give you a written offer and written terms before you commit. If you choose to sell, a title company handles the closing. We buy the house as-is, so you do not need to repair, clean, or clear it out to sell to us.
The payoff, title, court or trustee status, and time remaining before the sale all matter. A cash offer does not move a foreclosure date by itself; keep following the current notice unless the court, sheriff, or trustee confirms a change.
Nebraska foreclosure: trust deed or mortgage?
Nebraska home loans may be secured by a trust deed (also called a deed of trust) or a mortgage. With a trust deed, the lender can use a trustee’s sale without first going to court. With a mortgage, the lender must go to court, and a sheriff or court-appointed officer holds the sale. A sale for unpaid property taxes is different from either mortgage process; its notice and deadlines are separate.
If the loan uses a trust deed
The trustee records a notice of default with the county Register of Deeds. Before the loan’s original maturity, you can generally cure a payment default for one month after that notice is recorded by paying what is due plus allowed costs and fees; certain farm properties have two months. Principal due only because the loan was accelerated is excluded, but principal already due at maturity is not. After the applicable period, the trustee can publish the sale notice once a week for five weeks; the last notice must be 10 to 30 days before the sale, and a copy must be mailed at least 20 days before it. The trustee sells at public auction and can postpone the sale by announcement there. Nebraska does not give you a right to redeem the property after a completed trustee’s sale.
Read the Nebraska statutes on recording the default notice, curing the default, publishing the sale notice, mailing it, holding or postponing the auction, and the trustee’s deed after sale.
If the lender filed a mortgage foreclosure
The lender has to go through court. Within 20 days after the decree, you can file a written request to delay the sale. The delay can be nine months; for residential mortgages covered by the statute, it is three or six months in specified cases based on the loan’s original final-payment date and when the foreclosure complaint was filed. You can redeem by paying the court judgment, interest, and costs before the court confirms the sale. If the auction buyer is not the plaintiff, interest on that buyer’s purchase price also applies.
See Nebraska law on a request to delay a court-ordered sale and the right to redeem before court confirmation.
If you live in the house and foreclosure has started, a qualifying contract with a business buyer generally gives you until midnight of the third business day after signing, or noon on the last business day before the sale, whichever comes first, to cancel. The Nebraska Foreclosure Protection Act does not give that cancellation right if you first agree to the purchase on or after that noon deadline. See Nebraska Revised Statute §76-2721.
If the payoff is the problem
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.
Ask your lender or servicer for a current payoff. If you want to proceed, the title company can review that figure and any other liens against the written sale terms. A lender’s decision depends on the specific loan and transaction.
What happens next
- Call us or send the Grand Island property address. If you have a foreclosure or tax notice, share the date on it; you can start with the address even if you do not have every paper.
- We review the house as-is and give you a written offer and written terms before you decide whether to commit.
- If you choose to proceed, the title company reviews title, payoff, lien, and tax details as it prepares for closing.
- Keep following each current notice. A sale must be completed in time, and only the office handling that sale can confirm a changed date.
It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.
Hall County offices and sale information
Grand Island is in Hall County. These county links are starting points for local records and offices; they do not confirm the current status of a particular property or sale date. Match the address and case or parcel details, then confirm the date with the office or trustee named in your notice.
- Hall County Sheriff’s Office — the county page links to its Sheriff’s Sales records; confirm a current date with the office handling your sale.
- Hall County District Court information — start here for a mortgage case; use the current court papers and contact the court handling the case about its status.
- Hall County Register of Deeds — the office that records a trust-deed notice of default.
- Hall County Treasurer’s delinquent tax list — a separate starting point for property-tax questions, not a mortgage-foreclosure deadline.
You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront. A tax-sale notice and its deadline remain separate from any mortgage or trust-deed sale.
Questions and contact
Questions about foreclosure in Grand Island
Can I sell my Grand Island house before a foreclosure sale?
Often, yes, if the payoff, title work, any required court steps, and closing can be completed before the sale. The process and dates depend on whether the loan is secured by a trust deed or a mortgage. An offer by itself does not change a scheduled sale date.
Is a mortgage foreclosure the same as a property-tax sale?
No. A trust-deed foreclosure can lead to a trustee’s sale, and a mortgage foreclosure goes through court. A sale over delinquent property taxes is a separate process with its own notice and deadlines. Follow the contact and dates on each notice separately.
What if the payoff is more than my house is worth?
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before. Ask the lender or servicer for a current payoff so the title company can review it with the written sale terms and any other liens.
Do I have to pay back taxes or liens before selling to you?
You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront. A separate property-tax sale notice and its dates still need to be handled on their own.
Can I cancel a contract with a business buyer after foreclosure starts?
If you live in the house and your contract qualifies under Nebraska’s Foreclosure Protection Act, you generally have until midnight of the third business day after signing, or noon on the last business day before the sale, whichever comes first, to cancel. The Act does not give that cancellation right if you first agree to the purchase on or after that noon deadline.
Use the Grand Island home-sale calculator to compare possible sale proceeds. It is a planning estimate, not a payoff statement or property-specific offer.
