Can I Sell My Henderson House With Tenants Still Living There?

You're done — no turnover, no repairs, no more bad tenants.

Yes. USA Home Buyers buys houses as-is in the City of Henderson and Henderson County, Kentucky, including houses with tenants in place. A sale does not by itself end the lease; the buyer takes over as landlord. You can call now to talk through the lease, access, repairs, rent, deposits, and occupancy.

Call 888-274-5006 or use the form. You do not have to decide what should happen with possession before starting the conversation.

What we do

We buy houses as-is, in any condition — no repairs, no cleaning, no cleanout required to sell to us.

You don't always need to evict to sell to us. We buy houses with tenants in place — we've done it many times, including cash-for-keys when that works better for everyone.

Tell us whether you want to sell with the tenants in place or talk about helping them move. We can discuss the house and tenancy together, including the lease, access, and handoff.

Bring us the problem

Lease timing, limited access, needed repairs, unpaid rent, or a hard conversation with a tenant getting in the way? Tell us what is happening and what you want to happen with the property.

Call 888-274-5006 and talk it through.

What happens next

  1. 1. We discuss the lease, occupancy, and house

We talk through the Henderson address, who lives there, what the lease says, how access works, the house’s condition, rent and deposit records, and the timing you have in mind. Start with what you know.

  2. 2. You review a written cash offer and terms

We discuss the house as it stands and the tenancy. We give written cash offers in 24 hours.

You can review the written offer and terms before you commit. If you decide to sell, the title company carries the transaction through settlement.

  3. 3. The title company reviews the closing and handoff

If you choose to proceed, the title company handles the closing. The lease, occupancy, tenant notice, deposit balance, prorated rent, and any possession plan belong in the handoff discussion for this sale.

Kentucky leases, rent, possession, and security deposits

A sale does not by itself end the lease. Under KRS 383.100, Kentucky allows a rental-property sale without the tenant’s consent, and the buyer takes over as landlord. A tenant who pays rent to the former owner before receiving notice of the sale is not liable to pay that rent again. Tell each tenant in writing who the new owner is and where rent should go. A sale notice does not itself set a move-out date; any separate possession plan still has to account for the lease and applicable process.

Kentucky has no statewide rule for moving a security deposit when a rental is sold. In cities and counties that adopted Kentucky’s version of the Uniform Residential Landlord and Tenant Act, deposits must be kept in a separate bank account under KRS 383.500 and KRS 383.580. In a place covered by the Act, a seller who sells in good faith is relieved of liability only for events after the tenant receives written notice of the sale under KRS 383.600. Local adoption matters; do not assume the same deposit rule applies everywhere in Kentucky.

For a clear handoff, reconcile the deposit balance and any prorated rent with the buyer at closing, then tell each tenant in writing who now holds the deposit. The sale itself does not require tenants to move.

Henderson tenant-occupied house questions

Can I sell my Henderson house while tenants are still living there?

Yes. Kentucky law allows the sale without the tenant’s consent. The sale does not by itself end the lease, and the buyer takes over as landlord. USA Home Buyers buys houses as-is in the City of Henderson and Henderson County, including houses with tenants in place.

Do tenants have to move out when the house is sold?

No, not just because the house is sold. The sale does not by itself end the lease or set a move-out date. Any separate possession plan still needs to account for the lease and the applicable process.

Where should tenants pay rent after the sale?

Tell tenants in writing who the new owner is and where to pay. A tenant who pays the former owner before receiving notice of the sale is not liable to pay that rent again.

What happens to the security deposit when the house is sold?

Kentucky has no statewide rule for moving a security deposit at a sale. In places that adopted Kentucky’s Uniform Residential Landlord and Tenant Act, deposits must be kept in a separate bank account, and a good-faith seller is relieved of liability only for events after the tenant receives written notice of the sale. Reconcile the deposit and prorated rent with the buyer at closing, then tell each tenant in writing who holds the deposit.

Do I have to evict before I call?

You don't always need to evict to sell to us. We buy houses with tenants in place — we've done it many times, including cash-for-keys when that works better for everyone.
