What we do

You don't need to evict to sell to us. We buy houses with tenants in place — we've done it many times, including cash-for-keys when that works better for everyone. Tell us about the property and tenancy.

If a move-out arrangement may work better than an occupied handoff, we can talk through that option too. The lease, occupancy, and any deposit still need a clear handoff as part of the sale.

Bring us the problem

Lease timing, access limits, repairs, missed rent, or a difficult move-out conversation can make a sale feel complicated. Tell us what is happening; you can call before you have every detail or a plan for possession.

Call 888-274-5006 and talk it through, or use the form above.

What happens next

  1. 1. We discuss the house and tenancy

We talk about the property, who lives there, the lease and rent, access, repairs, deposits, and the timing you are considering. Start with what you know; you do not have to solve the tenancy before calling.

  2. 2. We put the offer and terms in writing

We give you a written cash offer within 24 hours. You can review the price and written terms before deciding whether to move forward.

Written offer and written terms before you commit; title-company closing.

  3. 3. The title company reviews the handoff

If you choose to proceed, the title company reviews ownership and closing documents. The lease, occupancy plan, and security-deposit records can be addressed as part of the written terms and closing handoff.

Texas lease, notice, possession, and security-deposit rules

A sale does not by itself cancel a lease. If the tenants remain, the buyer becomes the new landlord. Selling the house and ending a tenancy are separate questions; a sale alone does not set a tenant move-out date.

Texas Property Code §91.001 — month-to-month notice

If rent is monthly and the tenancy is month-to-month, either side may end it with notice. The tenancy ends on the later of the date stated in the notice or one month after the notice is given. A lease signed by both sides can set a different notice period. That notice rule is not triggered simply because the house is sold.

Texas Property Code §92.105 — deposits when ownership changes

From the day the buyer gets title, the new owner is responsible for returning the security deposit. The new owner must give each tenant a signed statement confirming the purchase, the new owner's responsibility for the deposit, and the exact dollar amount. As the seller, you remain responsible for deposits you collected until the new owner receives them or takes over that responsibility, unless your written contract says otherwise.

Put the deposit amount and handoff in the closing discussion. Keep the lease and deposit records with the sale documents so the transfer is clear.

What sellers say about USA Home Buyers

Killeen tenant-occupied seller questions

Can I sell my Killeen house while tenants are still living there?

Yes. We buy houses with tenants in place in Killeen and Bell County. A sale does not by itself cancel the lease, so occupancy and the lease are part of the handoff.

Do I have to evict the tenants before I call?

No. You can talk with us about selling before making a possession decision. We buy houses with tenants in place and can discuss cash-for-keys when that works better for everyone.

What happens to the security deposit when the house is sold?

Texas law makes the new owner responsible for returning the deposit from the date it receives title and requires a signed statement to each tenant with the exact deposit amount. As the seller, you remain responsible for deposits you collected until the new owner receives them or takes over that responsibility, unless your written contract says otherwise.

Can a sale end a month-to-month tenancy?

A sale does not itself end the tenancy. In Texas, either side may end a month-to-month tenancy with notice; it ends on the later of the date in the notice or one month after notice is given. A lease signed by both sides can set a different notice period.

What should I have ready before we talk?

Nothing has to be perfect. If available, have the property address, lease, rent and deposit records, occupancy and access details, repair concerns, written notices, and the timing you are considering.
