You can sell a Kentucky rental house without the tenant’s consent under KRS 383.100. The lease continues, the buyer becomes the landlord, and the sale does not set a move-out date.
Give tenants written notice identifying the new owner and where rent should be paid. A tenant who pays rent to the former owner before receiving notice of the sale is not liable to pay that rent again under KRS 383.100.
Kentucky has no statewide rule for transferring a security deposit when a rental is sold. In cities and counties that adopted Kentucky’s version of the Uniform Residential Landlord and Tenant Act under KRS 383.500, deposits must be kept in a separate bank account under KRS 383.580. In a place covered by the Act, a seller who sells in good faith is relieved of liability only for events after the tenant receives written notice of the sale under KRS 383.600.
For a clear handoff, pass the deposit balance and any prorated rent to the buyer at closing, then tell each tenant in writing who now holds the deposit and where rent should go.
