Mortgage foreclosure and tax sale have separate deadlines
An Alabama mortgage with a power of sale can generally be foreclosed without a court case. The mortgage-sale notice generally must run once a week for three successive weeks in a newspaper in the county, or in an adjoining county if none is published there. See the state rules for power-of-sale foreclosures and notice of sale. Follow the date and instructions in the notice for your property.
A property-tax sale is a different proceeding from a mortgage foreclosure, with its own notice and deadline. Asking to postpone a mortgage sale does not change a tax-sale date. Dale County Revenue can answer questions about the property-tax account.
After a mortgage foreclosure sale, Alabama gives certain people a limited right to redeem the property, meaning buy it back. For residential property with a homestead exemption claimed in the year of sale, the usual period is 180 days for a mortgage signed on or after January 1, 2016. Other property and older mortgages generally have a one-year period. For qualifying homestead property, missing required notice can change when the redemption period starts, but cannot extend it beyond one year after foreclosure. See the rules for redemption periods and notice and older mortgages.
Redemption is not extra time to stay in the house. A debtor or mortgagor still in possession must leave within 10 days after the purchaser's written demand or risk losing redemption rights; the amount to redeem can include the sale price, interest, and lawful charges. See Alabama's rules on possession after written demand and the amount needed to redeem.
If the payoff is the problem
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.
What happens next
- Call us with the Ozark property address and the mortgage or tax notice you have. You can start without having every payoff or title detail.
- We review the house as-is and give you a written cash offer and written terms before you decide whether to commit.
- If you choose to proceed, a title company reviews title, the mortgage payoff, liens, and tax balances as it prepares for closing.
- Keep following the date on each notice until the person handling that sale confirms a change.
Mortgage payoffs, liens, back taxes, and your share of current property taxes are separate from closing costs. When you sell to us, we pay the closing costs, including Alabama's deed tax.
It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.

Can I sell my Ozark house before an Alabama mortgage foreclosure sale?
Often, yes, if you close before the foreclosure sale.
Can you close before my foreclosure sale?
If a foreclosure sale is scheduled, tell us the date right away so we can try to close before it.
Does an Alabama mortgage foreclosure require a court case?
A mortgage with a power of sale can generally be foreclosed without a court case. The sale notice generally must be published once a week for three successive weeks in a newspaper in the county, or an adjoining county if none is published there. Check the mortgage and the actual sale notice for the process and date that apply.
Is a mortgage foreclosure the same as a property-tax sale?
No. A mortgage foreclosure and a property-tax sale are different proceedings, each with its own notice and deadline. Asking to postpone a mortgage sale does not change a tax-sale date. Dale County Revenue can answer questions about the property-tax account.
What happens after an Alabama mortgage foreclosure sale?
Alabama gives certain people a limited right to redeem, or buy the property back, after a foreclosure sale. For residential property with a homestead exemption claimed in the year of sale, the usual period is 180 days for a mortgage signed on or after January 1, 2016; other property and older mortgages generally have a one-year period. Redemption is not extra time to stay in the house, and the amount and deadline depend on the law and property facts.
What if the payoff is more than my Ozark house is worth?
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before. A current payoff statement and title review can show what would need to be addressed from a sale.
Do I have to pay back taxes before selling to you?
You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront.
