Can I Sell My Paris, TN House Before Foreclosure?
If a trustee's sale is scheduled, tell us the date right away so we can try to close before it.
Yes. In Tennessee, you can often sell before a mortgage foreclosure sale if the closing happens first. The notice, current payoff, title work, and time left before the sale all matter. If you are not sure which kind of notice you have, we can help you sort out the next question to ask.

How we help
A sale option that starts with the actual date
Tell us about the house and the notice you received. We review the property as-is, give you a written cash offer, and put the terms in writing before you commit. If you want to move forward, we work with the title company and the lender or servicer to check the payoff and title details and see whether a closing can happen before the scheduled sale.
A signed sale agreement is not a new trustee-sale date. Confirm any postponement or change directly with the servicer or trustee named in your notice.
Which sale is involved?
Mortgage foreclosure and a property-tax notice have different deadlines
Check who sent the notice and what it says. Many Tennessee home loans use a deed of trust. If it gives a trustee the power to sell, that trustee can auction the house without first filing a court case. That lender sale is different from a notice about unpaid property taxes. The trustee-sale dates below are not the deadline for a property-tax matter.
Usual notice rules for a Tennessee trustee sale
Under the notice rules in effect since July 1, 2025, the sale notice must appear at least twice in a newspaper published in the county. The first newspaper notice must be at least 20 days before the sale. The notice must also be posted online by a third-party internet posting company for at least 20 days in a row. The trustee must mail you a copy by registered or certified mail by the date of the first newspaper notice.
If the trustee postpones the sale
- Unless the loan papers forbid it, the trustee may postpone the sale without publishing a new newspaper notice. The sale must still happen within one year of the original date.
- A new date must be announced at the scheduled sale and posted online, unless the delay is less than five days.
- If the sale is delayed more than 30 days, the new date, time, and place must be mailed to you at least 10 days before the sale.
Read the notice and any later postponement notice closely. The person or company named in the notice can confirm the current date and where the online notice is posted.
If the payoff is the problem
When the payoff looks higher than the house value
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.
Ask your lender or servicer for a current payoff. The title company checks the amounts and title details for the property; what remains depends on the written sale terms and the payoffs due at closing.
You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront.
What happens next
From the notice to a title-company closing
1. We review the house and timing
We start with the property address, condition, and the current sale date so the offer discussion fits the situation.
2. You read the offer and terms
We give you the offer and terms in writing before you commit. You can review them and decide whether they work for you.
3. The title company checks payoff and title details
If you choose to move ahead, the title company works through the payoff and title information needed for closing. We coordinate with the lender or servicer about the amount due and work toward closing before the trustee-sale date.
4. The sale closes through a title company
You review the written terms and the final settlement figures before the closing is completed.
It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.
Local help
Henry County property-tax and court contacts
The Henry County Trustee is the route for property-tax questions and payments. The County lists the Clerk & Master as serving Chancery Court; if your paperwork names that court, use the County page to confirm the right contact. For any other notice, start with the office or person named on it. Confirm current hours and location directly.
The Henry County Trustee is not the trustee named in a mortgage notice: one handles county property-tax questions, while the mortgage notice names the person or company handling that lender sale.

Questions about foreclosure in Paris, TN
Can I sell my Paris, TN house before a trustee sale?
Often, yes, if the sale can close before the trustee auction. Share the date on the notice as soon as you contact us so we can review the payoff, title questions, and timing. A written offer does not itself change the scheduled sale date; confirm any change with the servicer or trustee named in your notice.
What notice dates apply to a Tennessee mortgage trustee sale?
Under the usual Tennessee rules in effect since July 1, 2025, the sale notice must run at least twice in a newspaper published in the county, with the first notice at least 20 days before the sale. It must also be posted online for at least 20 consecutive days, and a copy must be mailed by registered or certified mail by the first newspaper notice. Postponement rules are separate; check the actual notice and loan papers.
Is a property-tax sale the same as a mortgage trustee sale?
No. A mortgage trustee sale and a notice about unpaid property taxes are different matters. The mortgage trustee-sale notice periods on this page do not set a property-tax sale deadline. Follow the date and instructions on the tax notice and contact the office or court named there. Henry County directs property-tax questions and payments to the County Trustee.
What if my payoff is more than the house is worth?
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before. A lender reduction is not guaranteed for a particular sale. The current payoff and any title or lien amounts need to be checked for the property.
Can I sell a house with back taxes or liens?
You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront. A tax notice still has its own date, so share it with us and confirm its status with the office named on it.
