Mortgage foreclosure
Kentucky mortgage foreclosures go through circuit court. The lender files a lawsuit; if it wins a judgment, the court orders a public auction run by the master commissioner. Court rules generally require the commissioner to hold the sale within 90 days after the case is referred. Two disinterested people appraise the house first, and the sale is advertised at least once between 7 and 21 days before the auction. The court must confirm the sale before the buyer gets a deed.
The 90-day period runs from referral, not from a missed payment or first notice. If a master commissioner's sale is scheduled, tell us the date right away so we can try to close before it.
