Can I Sell My Scottsbluff House in Foreclosure?
If a trustee's sale is scheduled, tell us the date right away so we can try to close before it.
Yes. You may still be able to sell before a Nebraska foreclosure auction if the payoff, title, case status, and time to close line up. The sentence above is for a trust-deed sale. A mortgage foreclosure goes through court and may end in a sheriff's sale, so check which process and date appear in your notice.

How we help you work toward closing
USA Home Buyers buys houses as-is in Scottsbluff and Scotts Bluff County. We buy houses as-is, in any condition — no repairs, no cleaning, no cleanout required to sell to us.
We review the house and the timing you share. Written offer and written terms before you commit; title-company closing. If you choose to move forward, the title company reviews title and payoff details as the sale moves toward closing.
You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront.
When you sell to us, we pay the closing costs, including Nebraska's documentary stamp tax. This does not pay your mortgage, liens, back taxes, or your share of current property taxes.
Which sale is on your notice?
Nebraska uses different procedures for a trust-deed foreclosure and a mortgage foreclosure. A property-tax sale is separate from both. Start with the type of notice and the date printed on it; do not use one process's deadline for another.
Trust deed: notice and trustee's sale
With a trust deed, the lender can use a noncourt process. The trustee records a notice of default with the Scotts Bluff County Register of Deeds. For a qualifying payment default before the loan's original maturity, you generally have one month after that recording to cure by paying what is due plus allowed costs and fees; certain farm properties have two months. Principal due only because of acceleration is excluded, but principal already due at maturity is not. A later cure before the sale can involve different allowed costs and fees.
After the required waiting period, the trustee can publish the sale notice once a week for five weeks, with the last notice 10 to 30 days before the sale, and must mail you a copy at least 20 days before it. The trustee sells at public auction and can postpone the sale by announcing it at the auction. Nebraska does not give you a right to redeem the home after a trustee's sale.
Read the Nebraska statutes on the notice of default and cure period, published sale notices, mailed sale notice, public auction and postponement, trustee's deed without redemption, and reinstatement.
Mortgage: court case and sheriff's sale
With a mortgage, the lender must go to court, and a sheriff or court-appointed officer holds the sale. Within 20 days after the court's decree, you can file a written request to delay it. The delay can be nine months. For covered residential mortgages, the period is three months when the original final payment was more than 20 years after the foreclosure complaint was filed, or six months when it was more than 10 but no more than 20 years after filing.
You can redeem by paying the court judgment, interest, and costs before the court confirms the sale. Those court dates are separate from a trust-deed notice or a property-tax notice. Read Neb. Rev. Stat. §25-1506 on delaying a court-ordered sale and §25-1530 on redemption before confirmation.
Property-tax sale: a separate notice and deadline
A property-tax sale is not the lender's mortgage foreclosure or a trust-deed sale. Follow the tax notice and the deadline and contact it names; the mortgage and trust-deed timelines above do not set the tax-sale deadline. If both types of notices apply to your house, check each one separately.
A cancellation period may apply to a buyer contract
If you live in the home and foreclosure has started, Nebraska's Foreclosure Protection Act generally lets you cancel a covered contract to sell to a business buyer until midnight of the third business day after signing or noon on the last business day before the sale, whichever comes first. The Act gives no cancellation right if you first agree to the purchase on or after that noon deadline.
See the Nebraska statutes for equity purchasers, residence in foreclosure, and the homeowner's right to cancel.
If the payoff is the problem
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.
Ask your lender for a current payoff statement. The title company can review that figure with recorded liens and the sale terms; any lender decision is specific to the property and case.

Questions about selling before foreclosure in Scottsbluff, NE
Can I sell my Scottsbluff house before a foreclosure sale?
Yes. A sale may still be possible before the auction if the payoff, title, case status, and time to close line up. If a trustee's sale is scheduled, tell us the date right away so we can try to close before it. For a mortgage foreclosure, send us the sheriff-sale date shown in your court or sale notice.
What is the difference between a trust-deed sale and a mortgage foreclosure in Nebraska?
A trust deed can be foreclosed through a trustee sale without a court case; the trustee records a notice of default and follows the statutory sale notices. A mortgage foreclosure goes through court, and a sheriff or court-appointed officer holds the sale. The notice, deadline, and any option to cure or delay depend on which process applies.
Is a property-tax sale the same as a mortgage foreclosure?
No. A property-tax sale follows a separate process from a lender’s mortgage foreclosure or a trust-deed sale. Follow the tax-sale notice and its stated deadline; do not apply mortgage or trust-deed dates to it. If more than one notice applies, check each one separately.
Can I cancel a contract to sell my home during foreclosure?
If you live in the home and the foreclosure has started, Nebraska’s Foreclosure Protection Act may let you cancel a covered contract with a business buyer by midnight of the third business day after signing or noon on the last business day before the sale, whichever comes first. The Act provides no cancellation right if you first agree to the purchase on or after that noon deadline.
What if the payoff is more than my Scottsbluff house is worth?
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before. A current payoff statement and title review show what would need to be addressed at closing; any lender decision depends on that lender, property, and case.
