Can I Sell My Washington, NC House With Tenants Still Living There?

You're done — no turnover, no repairs, no more bad tenants.

Yes. You can sell the house with tenants still living there. A sale does not end the lease, so we will talk through the occupancy and handoff rather than assume the tenants have to leave first.

What we do

We buy tenant-occupied houses and talk through the lease, who is living there, access, condition, and timing. You don't always need to evict to sell to us. We buy houses with tenants in place — we've done it many times, including cash-for-keys when that works better for everyone.

Sometimes arranging a tenant move may work better for everyone than handing over an occupied house. If cash-for-keys is part of the discussion, we can talk through it alongside the property and tenancy; the lease and any agreement still matter.

We buy houses as-is, in any condition — no repairs, no cleaning, no cleanout required to sell to us.

Local help for a Washington rental

The City of Washington describes its Inspections Division service area as the city limits and extraterritorial jurisdiction (ETJ). The City also links separately to a Washington city-limits map and Beaufort County GIS. A Washington mailing address alone does not establish which boundary or office applies, so check the property address before relying on a city service.

For an inspection or code question about a property in the City's stated service area, contact the division and confirm how it handles the specific address.

City mapping and GIS links

Use the City's mapping page to reach the Washington city-limits map and Beaufort County GIS, then confirm the applicable office for the parcel.

North Carolina tenant rights, leases, notice, and deposits

Selling the house does not by itself cancel the lease. The buyer generally takes over as landlord, so the lease, occupancy, and any notice or possession question still matter after a sale.

The lease carries through the sale

A lease longer than three years must be recorded with the register of deeds to bind a buyer. Keep a copy of the lease and any record of it with the closing papers. See North Carolina General Statute 47-18.

The security deposit after a sale

North Carolina's Tenant Security Deposit Act covers rental deposits. Within 30 days after the sale, the seller must either transfer the deposit, minus lawful deductions, to the buyer and mail the tenant the buyer's name and address, or return the deposit, minus lawful deductions, to the tenant. Either step relieves the seller of further responsibility for that deposit. Keep the deposit balance and records for the closing discussion. See the Tenant Security Deposit Act and section 42-54 on transfer of the landlord's interest.

Notice for a tenancy with no set end date

To end a tenancy with no set end date, the notice depends on the rent period: month-to-month needs at least seven days before the end of the month; week-to-week needs two days before the end of the week; and year-to-year needs one month or more before the end of the year. A rented manufactured-home space needs 60 days. Check the lease too; it may require more. These notice periods do not by themselves give a landlord permission to remove a tenant. See North Carolina General Statute 42-14.

If a tenant will not leave

A tenant can be removed only through the court process. A notice or sale alone does not let an owner change locks or remove a tenant. See North Carolina General Statute 42-25.6.

Questions about selling a Washington house with tenants

Can I sell my Washington house while tenants are still living there?

Yes. A sale does not by itself end the lease; the buyer generally takes over as landlord. Tell us about the lease, occupancy, access, and house so we can discuss the sale with the tenants still there.

What happens to the security deposit when I sell?

Within 30 days after the sale, North Carolina law lets the seller transfer the deposit, minus lawful deductions, to the buyer and mail the tenant the buyer’s name and address, or return the deposit, minus lawful deductions, to the tenant. Either step ends the seller’s further responsibility for that deposit.

How much notice is needed to end a tenancy with no set end date?

The notice depends on the rent period: at least seven days before the end of the month for month-to-month, two days before the end of the week for week-to-week, and one month or more before the end of the year for year-to-year. A rented manufactured-home space needs 60 days. Check the lease too; it may require more.

Do I need to evict before I talk with you?

You don't always need to evict to sell to us. We buy houses with tenants in place — we've done it many times, including cash-for-keys when that works better for everyone.

What if a tenant does not leave?

A tenant who will not leave can be removed only through the court process. The sale itself does not cancel the lease or give the seller the right to remove a tenant outside that process.
