Mortgage trustee's sale
Virginia home foreclosures are usually trustee's sales under a deed of trust. The trustee auctions the house without a court case. For an owner-occupied home, written notice generally must go to the owner at least 60 days before the sale; for other property, the period is generally 14 days. The sale must be advertised in a local newspaper.
A trustee can postpone the sale, and a postponed sale must be advertised again. Plan to close and pay off the loan before the trustee's sale; do not count on buying the house back afterward. Have the trustee and title company or an attorney confirm the current sale date and payoff amount.
