A sale by itself does not end the lease or set a move-out date. Under 41 O.S. §41-114, the buyer takes over the landlord’s rights and obligations, and the tenant keeps the rights and obligations under the lease.
When a landlord’s interest ends by sale, the person holding the tenant’s security deposit must, within a reasonable time, either transfer it to the successor landlord and give the tenant written notice of the transfer and the successor’s name and address, or return the deposit to the tenant. A successor who receives the deposit takes the landlord’s rights and obligations for that deposit under 41 O.S. §41-115(C)–(D).
Tell us about the lease, who holds the deposit, and any notices or court papers. We can talk through the possession handoff with you.
