Can I Sell My Fayetteville House With Tenants Still Living There?

You're done — no turnover, no repairs, no more bad tenants.

That is the point of selling the rental to us: no turnover or repair round for you to manage after the sale. Yes, you can sell with tenants still living there. A sale does not cancel the lease; the buyer takes the house subject to it and becomes the new landlord.

USA Home Buyers buys houses as-is in Fayetteville and Lincoln County, Tennessee. We buy houses as-is, in any condition — no repairs, no cleaning, no cleanout required to sell to us. Call 888-274-5006 to talk through the property. We answer 24/7.

What we do

We can buy the house with the tenants in place

We talk through the house as it stands, who is living there, what the lease says, how access works, and what repairs are on your mind. You do not have to make the house vacant before we discuss a sale.

You don't always need to evict to sell to us. We buy houses with tenants in place — we've done it many times, including cash-for-keys when that works better for everyone. Tell us about the property and tenancy.

If a move-out arrangement could work better for everyone, we can discuss whether cash-for-keys fits the situation. We will talk through the plan with you rather than assume the tenant will leave.

Bring us the problem

Lease, access, or repairs getting in the way?

Tell us what is making the rental hard to manage: a lease question, limited access, needed repairs, or another round of turnover. Start with what you know. Call 888-274-5006 and talk it through.

What happens next

Start with the house and the tenancy

  1. 1. We discuss the property and occupancy

We talk about the address, condition, lease, who lives there, access, rent and deposit details, and the timing you are weighing. You can begin with the facts you have; you do not need to settle the possession question first.

  2. 2. We put a cash offer in writing

We give written cash offers in 24 hours. You get a written offer and written terms before you commit, and we close through a title company.

  3. 3. The tenancy and closing handoff are addressed

We discuss the lease, occupancy, rent and security-deposit balance, and any move-out arrangement you want to consider. The title company helps document the sale and the agreed handoff; a written sale does not itself cancel a lease or set a tenant's move-out date.

Local help

Lincoln County planning and zoning

If a county zoning or land-use question is part of the rental, Lincoln County Planning & Zoning handles planning and zoning compliance. The county lists its office at 112 Main Ave S, Room 107, Fayetteville, TN 37334; call (931) 438-5186. This is a land-use resource, not a source for lease, deposit, or possession questions.

Tenant rights and deposits

A sale does not end the lease

The buyer takes the house subject to the existing lease and becomes the new landlord. Tennessee's Uniform Residential Landlord and Tenant Act applies only in counties that had more than 75,000 people in the 2010 census. Lincoln County had 34,842 people, below that cutoff, so the Act's deposit-account, sale-notice and transfer, and periodic-tenancy notice rules do not apply to a Lincoln County rental. In counties where the Act does apply, a landlord must keep security deposits in an account used only for deposits and tell tenants where the account is.

Only in a county where the Act applies, and unless agreed otherwise, a seller who sells in good faith is released from the lease for later events only after the tenant gets written notice of the sale and the deposit is transferred to the buyer. In those covered counties, ending a month-to-month tenancy takes written notice at least 30 days before the rent date named in the notice; a week-to-week tenancy takes at least 10 days' written notice. A fixed-term lease and other legal protections may call for a different approach.

We talk through the lease, notice, possession, and deposit handoff with you. The tenant's lease does not disappear when the deed changes hands, and a sale by itself does not require the tenant to move.

The related provisions are Tenn. Code Ann. §§ 66-28-301, 66-28-305, and 66-28-512.

Fayetteville tenant-occupied questions

Can I sell my Fayetteville house with tenants still living there?

Yes. A sale does not cancel the lease. The buyer takes the house subject to it and becomes the new landlord, so you can talk with us while the tenants are still there.

Do I have to evict the tenants before I call?

No. You don't always need to evict to sell to us. We buy houses with tenants in place — we've done it many times, including cash-for-keys when that works better for everyone.

What happens to the security deposit when the house sells?

Lincoln County had 34,842 residents in the 2010 Census, below the county threshold for Tennessee's Uniform Residential Landlord and Tenant Act. Its sale-notice and deposit-transfer rule therefore does not apply to a Lincoln County rental. The lease still survives the sale, and we discuss the rent and deposit handoff with you and the buyer.

Where can I ask about a Lincoln County zoning or land-use issue?

Lincoln County Planning & Zoning handles county planning and zoning compliance. Its listed office is at 112 Main Ave S, Room 107, Fayetteville, TN 37334; call (931) 438-5186 or use the county office link below.

What should I know before we talk?

Start with the property address and what is happening with the lease, access, or repairs. We can talk through the house and tenancy with you; you do not have to solve every tenant question before calling.
