Which sale is involved?

In Texas, a lender usually forecloses without filing a court case. A trustee or substitute trustee conducts the nonjudicial sale. For a property used as your residence, the loan servicer must first send written notice of default by certified mail and give you at least 20 days to catch up before a sale can be noticed. Then, at least 21 days before the sale, the notice of sale must be posted at the courthouse, filed with the county clerk, and sent by certified mail to each borrower.

The public auction is usually on the first Tuesday of the month between 10 a.m. and 4 p.m., at the county courthouse. It must start no later than three hours after the time stated in the notice. Property-tax sale: separate notices and dates

A sale over delinquent property taxes is not the lender’s mortgage trustee sale. The notices and deadlines are separate; do not use the mortgage foreclosure timeline to work out a tax-sale date.
