Does Montana charge a transfer tax when I sell my house?
No. Montana has no state, county, or city transfer tax on a home sale. A realty transfer certificate still has to be filed with the county clerk and recorder when the deed is recorded. Can I sell an inherited Montana house before probate is finished?

Can I sell a Montana rental with tenants still living there?
Yes. Selling does not cancel the lease; the buyer takes the house subject to it and becomes the new landlord. Unless otherwise agreed, Montana law relieves a landlord in a good-faith sale from duties for events after the tenant receives written notice of the sale, while treating the security deposit and prepaid rent separately. Can I still sell if a Montana trustee’s sale is scheduled?
Often, yes, if you close before the foreclosure sale. Many home loans on property of 40 acres or less use a trust indenture, which lets the lender hold a trustee's sale without going to court. The notice must be recorded and mailed at least 120 days ahead, published for three weeks, and posted on the property at least 20 days before the sale. Before the trustee's sale, you can generally cure a payment default by paying the amount in default plus allowed costs and fees. There is no redemption after a trustee's sale; a court foreclosure generally gives the owner up to one year after the sale to redeem.
