Can I Sell My Helena House in Foreclosure?
Our agreement of sale will often get a trustee's sale postponed so we can close. Signing alone doesn't postpone it automatically; we use the agreement to ask for the postponement, and it works more often than people think.
Often, you can still sell if the transaction can close before the foreclosure sale and the payoff and title details work. If you have received a notice, use its date and ask the lender or trustee for the current payoff and sale status. If a sale has already happened, the next steps depend on whether it was a trustee sale or a court foreclosure.

How we help you work toward a closing
We review the Helena house as it is, the notice and sale date, the loan payoff, and any title or lien questions. Before you commit, we provide the offer and terms in writing; the closing takes place through a title company. A sale still has to fit the actual deadline and the property's payoff and title requirements.
You can call or use the form to tell us what notice you received and when the sale is set. We can review an as-is sale option while you confirm the current date and requirements with the lender or trustee.
Montana trustee sales and court foreclosures
Montana allows mortgage foreclosure through the courts. Many home loans secured by property of 40 acres or less use a trust indenture, which lets the lender use a trustee to conduct a sale without first filing a court case. The two paths have different notices and deadlines. See the state law on trust indentures and court foreclosures.
- The trustee-sale notice must be recorded and mailed at least 120 days before the sale. It is published for three weeks and posted on the property at least 20 days before the sale. Review the details in Montana's notice and sale law.
- Before a trustee's sale, you can generally cure a payment default by paying the amount in default plus allowed costs and fees. Principal due only because the lender accelerated the loan is excluded, but principal already due at maturity must still be paid. See the state's cure-before-sale rule.
- A trustee sells at public auction. Outside a bankruptcy or court stay, the trustee can postpone the sale by announcement for up to 15 days. There is no redemption period after a trustee's sale. See the law on auction and postponement and the trustee's deed.
- In a court foreclosure, the owner generally has up to one year after the sale to redeem the property. That is a different path from a trust-indenture sale; check the court record and applicable deadline. See Montana's court-sale redemption law.
Mortgage foreclosure or tax sale?
A mortgage foreclosure enforces a home loan; a tax sale concerns unpaid property taxes. They are separate processes with separate notices and deadlines. The trustee-sale postponement described above does not change a tax-sale deadline. Follow the notice you received and contact the office named on it. For Lewis and Clark County office details, see the official Clerk and Recorder/Treasurer page.
If the payoff is the problem
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.
Ask the lender for a current payoff figure. The amount needed to close depends on that figure, title, and any other liens on the property.
What happens next
- Tell us the property address, what notice you received, and the date shown on it.
- Review our written offer and written terms before deciding whether to commit.
- The title company checks ownership and obtains payoff information for the mortgage, liens, back taxes, and other amounts due. You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront.
- Work through the title requirements and close if the sale can meet the applicable deadline.
When you sell to us, we pay the closing costs. Mortgage balances, liens, back taxes, and your share of current property taxes are separate from that promise and are handled in the closing figures.
It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.
Local county information
Lewis and Clark County lists its Clerk and Recorder/Treasurer and Records Department on its official site. For a mortgage trustee sale, use the trustee's notice and confirm the current date with the trustee or lender; the county office listing does not confirm that a specific sale has been postponed.
Helena foreclosure questions and contact
Questions about a Helena foreclosure
Can I sell my Helena house before a trustee's sale?
Often, yes, if the sale can close before the foreclosure sale. Check the trustee's notice for the current date and confirm directly with the trustee or lender; do not assume signing a contract changes the date.
How is a court foreclosure different from a trustee sale in Montana?
A trust-indenture trustee sale is a public auction outside a court foreclosure. A court foreclosure follows a separate process, and the owner generally has up to one year after the sale to redeem the property. The notices and court record control the deadline for a specific house.
Does a mortgage trustee-sale deadline also apply to a tax sale?
No. A tax sale concerns unpaid property taxes and follows a separate notice and deadline process; it is not the lender enforcing a mortgage or trust indenture. Follow the notice you received and contact the office named there.
