4 · Montana and Lewis and Clark County details

Helena is in Lewis and Clark County. Montana does not charge a state, county, or city transfer tax when real property is sold. The Montana Constitution bars the state and local governments from taxing the sale or transfer of real property.

There is still a filing: a Realty Transfer Certificate must go to the county Clerk and Recorder when the deed is recorded. It is paperwork, not a transfer tax. The Montana Department of Revenue uses it to update ownership records and gather sale information for property appraisals.

The certificate asks whether water rights go with the property. If the property has its own water right, the state water-right ownership records also need an update. That separate update does not apply when the property is served by a public water supply.
