A court must appoint a personal representative—an executor or administrator—before the representative can act for the estate. See KRS 395.015.

  • If the will gives the appointed personal representative power to sell real estate, that representative can usually sell without a separate court order.
  • If the will does not give that power, Kentucky’s general list of personal representative powers does not include selling land.
