Martin, TN / Foreclosure

Can I Sell My Martin House in Foreclosure?

If a trustee's sale is scheduled, tell us the date right away so we can try to close before it.

Often, yes. You may still be able to sell before the foreclosure auction if the loan payoff, title work, and closing can be completed in time. If there is no sale date yet, review the notices you have and ask your lender for the current payoff.

How we help with a Martin foreclosure sale

We review the house and the notice with you, then give you a written offer and written terms before you commit. If you choose to sell to us, closing is through a title company. We buy houses as-is, in any condition — no repairs, no cleaning, no cleanout required to sell to us.

When you sell to us, we pay the closing costs, including Tennessee's realty transfer tax. Your mortgage, liens, back taxes, and share of current property taxes are separate.

We review the payoff, title, and current sale status to see whether there is time to close before the date on your notice. If a trustee's sale is scheduled, tell us the date right away so we can try to close before it.

Mortgage foreclosure and a tax sale are different

Many Tennessee home loans use a deed of trust. When it gives the trustee a power of sale, the trustee can sell the house at a public auction without filing a court case. A county property-tax sale is a separate matter, with its own notice and deadline. If you have both notices, check each date separately.

Under the usual mortgage-sale notice rules in effect since July 1, 2025, notice must appear at least twice in a newspaper published in the county, and the first notice must run at least 20 days before the sale. The notice must also be posted online by a third-party internet posting company for at least 20 days in a row. The trustee must mail you notice by registered or certified mail by the date of the first newspaper notice. See Tennessee’s current trustee-sale notice rules.

Unless the loan papers forbid it, the trustee may postpone the sale one or more times without a new newspaper notice, but the sale must still happen within one year of its original date. A new date must be announced at the scheduled sale and posted online unless the delay is less than five days. If the sale is delayed more than 30 days, the new date, time, and place must be mailed at least 10 days before the sale. Check the current notice and confirm any new date with the trustee.

After a sale under a deed of trust or mortgage without a court judgment, Tennessee law generally gives you two years to redeem unless the document expressly waives that right (Tenn. Code Ann. § 66-8-101). A court-ordered sale follows different rules. A post-sale redemption right is not the same as closing a sale before the auction.

If the payoff is the problem

Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.

Ask your lender or servicer for a current payoff statement. If you want to proceed, the title company can review the payoff and other liens against the written sale terms.

If back taxes are part of the problem

You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront.

That does not change a tax-sale notice or deadline. Check the property-tax notice separately and contact the office named on it.

What happens next

  1. Call us or send the Martin or Weakley County property address and the foreclosure or tax notice you have.
  2. We review the house as-is and give you a written cash offer and written terms before you decide whether to commit.
  3. If you choose to proceed, a title company reviews title, payoff, liens, and closing details with you.
  4. Keep following the current date on each notice unless the office handling that sale confirms a change.

It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.

Weakley County and Martin contacts

For a county real-estate-tax question, contact the Weakley County Trustee at 731-364-3643. For a City of Martin tax notice, use the city’s official website and its “Pay My Property Tax” route. City and county boundaries are separate; use the office and jurisdiction shown for the actual address and notice. The City of Martin maps are published by the City. If it is unclear whether an address is inside city limits, confirm it with the relevant city or county office.

Tennessee requires online posting by a third-party internet posting company. The Tennessee Secretary of State’s list of third-party internet posting companies lists posting companies. Use the information in your notice to find the posting for your sale, and confirm the current sale date with the trustee.

Martin TN foreclosure questions

Can I sell my Martin house before a trustee’s sale?

Often, yes, if the required payoff, title work, and closing can be completed before the sale. If a trustee's sale is scheduled, tell us the date right away so we can try to close before it. The current notice and sale date still matter.

Is a mortgage foreclosure the same as a Weakley County tax sale?

No. A mortgage foreclosure and a property-tax sale are separate proceedings with separate notices and deadlines. Check each notice on its own; a change to one sale date does not change the other.

What notice is required before a Tennessee trustee’s sale?

Under the usual rules in effect since July 1, 2025, notice is published in a county newspaper at least twice, with the first publication at least 20 days before the sale. It must also be posted online for at least 20 consecutive days, and the trustee must mail notice by registered or certified mail by the date of the first newspaper notice. Read your own notice and confirm the current date.

What if the mortgage payoff is more than my house is worth?

Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before. Ask your lender for a current payoff so the title company can review it with the written sale terms and other liens.

Can I redeem my house after a Tennessee trustee’s sale?

For a sale under a deed of trust or mortgage without a court judgment, Tennessee law generally gives a two-year right to redeem unless the deed of trust or mortgage expressly waives it. A court-ordered sale follows different rules.
