How we help before a foreclosure sale

We review the property and timing, then give you a written cash offer and written terms before you commit. If you choose to move forward, a title company handles the closing. We buy houses as-is, in any condition — no repairs, no cleaning, no cleanout required to sell to us.

When you sell to us, we pay the closing costs, including Tennessee's realty transfer tax. Your mortgage payoff, liens, back taxes, and share of current property taxes are separate; the title company checks the figures for the property.

Mortgage foreclosure or property-tax sale?

Many Tennessee home loans use a deed of trust. When it gives the trustee a power of sale, the trustee can auction the house without first filing a court case. A court-ordered sale follows different rules. A sale for unpaid property taxes is a separate process with its own notices and dates; do not use mortgage-foreclosure deadlines for a tax-sale notice.

Under the usual Tennessee mortgage-sale notice rules in effect since July 1, 2025, the sale notice must run at least twice in a newspaper published in the county. The first newspaper notice must be at least 20 days before the sale. The notice must also be posted online by a third-party internet posting company for at least 20 days in a row. The trustee must mail you a copy by registered or certified mail by the date of the first newspaper notice.

Unless the loan papers forbid it, the trustee may postpone the sale one or more times without a new newspaper notice, but the sale must still happen within one year of the original date. Each new date must be announced at the scheduled sale and posted online unless the delay is less than five days. If the sale is pushed back more than 30 days, the new date, time, and place must be mailed to you at least 10 days before the new sale date. Check your notice and confirm the current date with the trustee.

For a sale under a deed of trust or mortgage without a court judgment, Tennessee law gives a two-year right to redeem unless the deed of trust or mortgage expressly waives it. A court-ordered sale has different rules. This is a post-sale right, not extra time to close before the sale. See Tenn. Code Ann. § 66-8-101.

If the payoff is the problem

Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.

Ask your lender for a current payoff so it can be reviewed with the title and closing figures for the property. What a lender will accept depends on the particular loan and sale.

What happens next

  1. Contact us by phone or form with the address and any trustee-sale date shown on your notice.
  2. We review the property and timing and give you written offer terms before you commit.
  3. If you choose to proceed, a title company checks title, payoff information, liens, and closing figures.
  4. The title company coordinates closing if the required steps can be completed before the sale date.

It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.

Warren County offices and sale information

For a mortgage trustee sale, use the notice and trustee named there; the Tennessee Secretary of State lists third-party websites used to post sale notices. For a property-tax notice, follow its dates and contact instructions. The Warren County Trustee can answer county property-tax account questions.

Compare possible sale proceeds

A calculator can help compare possible proceeds, but it is not a payoff quote or an offer for your property. The lender payoff, liens, and closing figures are specific to the house.

Questions About Foreclosure in McMinnville, TN

Can I sell my McMinnville house before a trustee sale?

Often, yes, if the payoff, title work, and closing can be completed before the mortgage foreclosure sale. If a trustee's sale is scheduled, tell us the date right away so we can try to close before it. An offer alone does not change the sale date; check the notice and confirm the current date with the trustee.

What notice dates apply to a Tennessee mortgage trustee sale?

Under the usual Tennessee notice rules in effect since July 1, 2025, the sale notice must run at least twice in a newspaper published in the county, with the first notice at least 20 days before the sale. It must also be posted online by a third-party internet posting company for at least 20 days in a row. The trustee must mail a copy by registered or certified mail by the date of the first newspaper notice. Postponements have separate rules, and court-ordered sales follow different rules.

Is a Warren County property-tax sale the same as a mortgage foreclosure?

No. A property-tax sale and a mortgage foreclosure are separate processes with separate notices and dates. Do not apply mortgage trustee-sale deadlines to a tax-sale notice. Follow the notice and contact instructions for the tax sale; the Warren County Trustee can answer county property-tax account questions.

What if my lender payoff is more than my McMinnville house is worth?

Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before. A title company can review the current payoff with the title and closing figures for the property; a payoff reduction is not promised for a particular sale.

Can I redeem a Tennessee house after a trustee sale?

For a sale under a deed of trust or mortgage without a court judgment, Tennessee law gives a two-year right to redeem unless the deed of trust or mortgage expressly waives it. A court-ordered sale has different rules. This is a post-sale right, not extra time to close before the sale.
