Can I Sell My Nashville House Before Foreclosure?
If a trustee's sale is scheduled, tell us the date right away so we can try to close before it.
Often, yes. You may be able to sell before a mortgage sale if the payoff, title work, and closing steps can be completed in time. A court-ordered sale follows different rules, and a property-tax case has its own notices and dates.

How we help you work toward closing
Before you commit, we put the cash offer and terms in writing. If you choose to sell, a title company works through the title, payoff, and closing details with you.
You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront.
When you sell to us, we pay the closing costs, including Tennessee's realty transfer tax. Mortgage balances, liens, back taxes, and your share of current property taxes are separate from that promise.
Which sale is on your notice?
Mortgage foreclosure: a trustee sale
Many Tennessee home loans use a deed of trust. If it gives the trustee the power to sell, the trustee can auction the house without first getting a court judgment. The notice tells you the sale date and steps for your loan.
Under the usual notice rules effective July 1, 2025, the sale notice must run at least twice in a newspaper published in the county, with the first notice at least 20 days before the sale. It must also be posted online by a third-party internet posting company for at least 20 days in a row. The trustee must mail you a copy by registered or certified mail no later than the first newspaper notice. Read the Tennessee 2025 update to the trustee-sale notice law and the Secretary of State website-address information for internet posting companies.
Unless the loan papers forbid it, the sale can be postponed one or more times without another newspaper notice, but it must happen within one year of the original date. A new date must be announced at the scheduled sale and posted online unless the delay is less than five days. If the delay is more than 30 days, the new date, time, and place must be mailed to you at least 10 days before the sale.
After a sale under a deed of trust or mortgage without a court judgment, Tennessee law gives a two-year right to redeem unless the deed of trust or mortgage expressly waives it. A court-ordered sale follows different rules. See Tenn. Code Ann. §66-8-101.
Property-tax sale: a separate case
A property-tax sale is not the mortgage trustee sale. It has a separate case, notice, and deadline; changing one sale date does not change the other. Davidson County property-tax-sale information is handled locally through the Chancery Court Clerk and Master. Check the case number and current date on the tax notice with that office.
If the payoff is the problem
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.
A current payoff and title review show what figures need to be addressed at closing. A mortgage payoff and a property-tax case are separate items, with separate notices and dates.
What happens next
- Call or send the Nashville property address and the notice or case number you have.
- We review the house as-is and give you written offer terms before you commit.
- If you choose to proceed, a title company checks title and payoff details while we work toward closing.
- Keep following the current sale notice. Confirm any change with the trustee or court named on it; a contract or request by itself does not confirm a new sale date.
It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.
Davidson County sale information
For a property-tax case, the Davidson County Chancery Court Clerk and Master provides court and local property-tax-sale information. Its contact page has office details. Use the notice and case number to confirm the current date.
For a real-property tax bill or payment question, use the Office of the Metropolitan Trustee's Davidson County real-property tax information. For a mortgage trustee sale, use the date in the trustee's notice and the county newspaper and online notice sources described above.
Questions About Selling Before Foreclosure in Nashville, TN
Can I sell my Nashville house before a trustee sale?
Often, yes, if the payoff, title work, and closing can be completed before the sale. If a trustee's sale is scheduled, tell us the date right away so we can try to close before it. Keep following the current notice unless the trustee or court confirms a change.
Is a mortgage foreclosure the same as a Davidson County tax sale?
No. A mortgage trustee sale concerns the home loan. A property-tax sale is a separate matter with its own notices and dates. Davidson County local property-tax-sale information is available through the Chancery Court Clerk and Master; check each notice and case separately.
How much notice comes before a Tennessee trustee sale?
Under the usual rules effective July 1, 2025, a notice for a power-of-sale auction must be published in a county newspaper at least twice, with the first publication at least 20 days before the sale. It must also be posted online for at least 20 consecutive days, and the trustee must mail you a copy by the first newspaper notice. Loan documents and the notices for your property still matter.
What if my Nashville house has back taxes or liens?
You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront. A pending property-tax case still has its own court notices and dates.
What if the payoff is more than my house is worth?
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.
What happens after I contact USA Home Buyers?
We review the house as-is and give you written offer terms before you commit. If you choose to proceed, a title company reviews title and payoff details while we work toward closing. Whether a sale can finish before a scheduled date depends on the actual notice, title, payoff, and time available.
