Which sale is involved?
Mortgage foreclosure: a trustee’s sale
California home loans commonly use a deed of trust. Most foreclosures are nonjudicial, meaning the trustee named in the deed of trust runs the process without a lawsuit. The trustee records a notice of default. After a 90-day cure period, a notice of sale can follow; it must be posted, published, and recorded at least 20 days before the sale. The sale is a public auction called a trustee’s sale.
You can usually reinstate by catching up until five business days before the trustee’s sale, and pay off the loan up to the sale itself. After a nonjudicial trustee’s sale, there is no right of redemption. Have the title company or an attorney confirm the current sale date and payoff.
A trustee may postpone a sale at the lender’s instruction or by agreement. For one-to-four-unit homes, state law also allows limited 45-day postponements tied to a broker listing and a qualifying purchase agreement; this does not apply to every sale. Confirm any change with the trustee rather than assuming the date has moved.
