Helpful California rule

What to check about documentary transfer tax

California counties charge documentary transfer tax of $0.55 for each $500 of value, or fraction of $500 ($1.10 per $1,000). It applies when consideration is over $100, not counting a lien or loan that stays on the property after the sale. Some transfers are exempt.

A city may take half of the county rate as its own share, credited against the county tax, so the combined rate usually stays at $1.10 per $1,000. Some cities add a larger transfer tax on top. The County Recorder collects the tax when the deed is recorded. State law makes a person who signs or benefits from the deed responsible for the tax, while the purchase agreement can allocate the cost between buyer and seller. Ask the title or escrow company to confirm the property's county, any city tax, taxable amount, exemption, and agreement allocation.

When you sell to us, we pay the closing costs, including the county documentary transfer tax and any city transfer tax. This promise never pays your mortgage, liens, back taxes or your share of current property taxes.

Questions about Ventura County offices and selling costs

Which Ventura County office handles property value or assessment questions?

Use the Ventura County Assessor for assessed value, assessment records, and property-search questions. The Assessor is separate from the Treasurer–Tax Collector, which handles property-tax payment and tax-defaulted-property information.

Where should I check unpaid property taxes in Ventura County?

Start with the Ventura County Treasurer–Tax Collector’s tax-payment information and use the County’s tax-defaulted-property information for that separate question. Confirm the current balance, status, and any timing for the specific parcel with the County and your title or escrow contact.

Does the County Recorder tell me whether a court judgment is active?

The Recorder handles county recording and official land-record contacts; a judgment is a court-case matter. Follow the court and case information on the judgment, use the Ventura Superior Court phone directory to find the right court contact, and ask a title professional how a specific record relates to the property. The Probate Division number listed here is for probate contact, not a civil-judgment determination.

Where can I start with a probate question for an Oxnard property?

Ventura County Superior Court lists a Probate Division contact at the Juvenile Justice Center in Oxnard. Call (805) 289-8820 for that division’s contact route. The property address alone does not establish an estate’s venue or who may sign; use the actual estate and court records for those questions.

What should I confirm about California documentary transfer tax?

Ask the title or escrow company to confirm the taxable amount, whether any city tax applies, any exemption, and how the purchase agreement allocates the cost. County tax is generally $0.55 for each $500 of taxable consideration, or fraction of $500, when consideration exceeds $100; some transfers are exempt and some cities add tax.
