Pottsville, PA / Foreclosure

Can I sell my house in foreclosure in Pottsville, PA?

We buy houses as-is in Pottsville and Schuylkill County.

Yes. You can call us now and ask for a cash offer, even while you are sorting out a lender notice, payoff information, or a sale date.

If a sheriff sale is coming up

You won't be doing this alone. We've been through this many times and we move fast. Our agreement of sale will often get a sheriff's sale postponed so we can close. It doesn't always work, but it works more often than people think — call us and we'll walk you through it.

A house that needs work can still be discussed

We buy houses as-is, in any condition — no repairs, no cleaning, no cleanout required to sell to us.

Worried the payoff may be higher than the house is worth?

Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.

What happens after you contact us

  1. 1. Start with the address and what you know

Tell us about the house and any lender or tax notices. You do not need to have every answer before you call or send a request.

  2. 2. We review the house as it stands

We look at its condition and the information you share, then discuss a direct-sale option with you.

  3. 3. Read the terms before deciding

Written offer and written terms before you commit; title-company closing.

  4. 4. The title company works through closing details

If you decide to move ahead, the title company—the business that checks ownership and handles closing—reviews who owns the house, who can sign, and payoff information, then prepares the closing documents. Once the title company and the people involved have what they need, you sign the agreed closing papers and the title company handles settlement under the written terms.

Mortgage foreclosure and sheriff sale

For certain delinquent mortgages on a Pennsylvania one- or two-family home that is the borrower's principal residence, the lender must send an Act 91 pre-foreclosure notice before filing. If you receive one and want to seek help through the Homeowners' Emergency Mortgage Assistance Program (HEMAP), meet a designated housing counselor within 33 days; the counselor then has 30 days from that meeting to submit an application to the Pennsylvania Housing Finance Agency (PHFA). HEMAP is a state mortgage-assistance loan program for mortgage cases, not delinquent property-tax sales. Read the Pennsylvania Housing Finance Agency's Act 91 and HEMAP guidance.

Pennsylvania Rule of Civil Procedure 3129.2 generally requires written notice at least 30 days before a sheriff sale for people identified through the affidavit, a sworn filing, in Rule 3129.1. Read the Pennsylvania sheriff-sale notice rule.

An agreement of sale by itself does not pause a sheriff's sale. Under Rules 3129.3 and 3183, postponement and a stay—an order pausing enforcement—go through the plaintiff, the party that brought the case, the sheriff, and the court process. A stay may require the plaintiff's written direction to the sheriff, a legal right under a statute, or a court order. If a sale date is listed, contact the plaintiff or sheriff promptly and confirm directly that the date actually changed. Read the rules for postponement and stays of execution.

Delinquent property taxes and tax sale

Unpaid property taxes can lead to a separate county tax sale, and the county's notice gives the sale date. Pennsylvania's Real Estate Tax Sale Law includes an upset sale, the county's sale process for delinquent property taxes. Section 602 requires notice at least 30 days before a scheduled upset sale in two county newspapers if that many are published and in the legal journal if there is one; the law also has separate owner-mail and posting requirements. If your house sale closes before the date in the county notice, delinquent taxes may be paid from the proceeds only if enough remains after other liens and closing costs. A sale agreement alone does not resolve the tax claim. Call us as soon as a notice arrives; timing matters. Read the Real Estate Tax Sale Law, §§ 601–603, and the Section 602 upset-sale notice rule.
