What we do

We talk about the house as it stands and the tenancy—who lives there, what the lease says, how access works, and what repairs are needed. You can discuss a sale while the tenants are still there.

You don't always need to evict to sell to us. We buy houses with tenants in place — we've done it many times, including cash-for-keys when that works better for everyone.

Sometimes helping the tenants move may work better for everyone. Tell us if you want to discuss a move-out arrangement along with the house and its condition.

Maine tenant rights, notice, and security deposits

A sale does not by itself cancel the tenants’ rights. The buyer steps in as the new landlord, and a written lease stays in force for its term.

If the tenancy is month-to-month and at will, ending it generally takes at least 30 days’ written notice. A sale is not one of the reasons Maine allows a shorter notice under 14 M.R.S. §6002. The actual lease and tenancy matter.

On a sale, the seller must either give each security deposit to the buyer with an accounting or return it to the tenant, less lawful deductions. If the deposit goes to the buyer, the seller must mail each tenant notice with the buyer’s name and address and a copy of the accounting. The transfer and accounting are due no later than closing, and the seller must give the buyer written proof at closing. Once that is done, the seller is released from further liability for those funds.

The buyer then takes responsibility for the deposits, must keep them separate from its own money, and must return them as Maine law requires. See 14 M.R.S. §6035, transfer of a security deposit and §6038, treatment of the deposit by a new owner.

Presque Isle tenant-occupied seller questions

Can I sell my Presque Isle house while tenants still live there?

Yes. USA Home Buyers buys tenant-occupied houses as-is in Presque Isle and Aroostook County. A sale by itself does not cancel the tenants’ rights or a written lease.

Do I have to evict before I talk with you?

You don't always need to evict to sell to us. We buy houses with tenants in place — we've done it many times, including cash-for-keys when that works better for everyone.

Does a sale end the lease or set a move-out date?

No. A sale does not by itself cancel a written lease, which stays in force for its term. A month-to-month tenancy at will generally takes at least 30 days’ written notice to end, and a sale is not a reason for shorter notice under Maine law.

What happens to the security deposit when the house is sold?

The seller must either transfer the deposit to the buyer with an accounting or return it to the tenant less lawful deductions. If transferred, the tenant must receive written notice with the buyer’s name and address and a copy of the accounting; the transfer and accounting are due no later than closing.

Who can I contact about a Presque Isle code question?

For a code or land-use issue involving property within City jurisdiction, contact the City of Presque Isle Code Office. It lists Code Enforcement Officer Jason Perry at (207) 764-2570.

What should I have ready before I call?

Nothing has to be perfect before you call. If available, have the property address, lease, rent and deposit information, access details, notices, repair concerns, and the timing you are considering nearby.
