A family relationship, being named in a will, or having the keys is not enough by itself to show who can sign. In Minnesota, a personal representative generally must be appointed, qualify, and receive Letters before taking on that role. Minnesota Statutes section 524.3-103 describes that appointment step. Letters are the official papers showing who has been appointed; check that they are current and whether they list co-representatives, restrictions, bond conditions, or later court orders.
The deed and title records also matter. Survivorship, a transfer-on-death deed, a trust, a life estate, or another arrangement may mean the house does not pass through the estate. A specific gift in a will, a surviving spouse's homestead interest, co-representatives, or an order can affect who must sign or consent. Have the title company or a qualified attorney review the actual deed, current Letters, will, and court file.

Minnesota deed tax depends on the instrument and its net consideration. The state statute sets a baseline of $1.65 when net consideration is $3,000 or less, and 0.0033 of net consideration when it is above $3,000. The closing professional must classify the actual deed and applicable tax treatment; an estate distribution deed and a direct sale to a buyer are not interchangeable. Minnesota's Department of Revenue says deed tax is not due on a qualifying deed of distribution by a personal representative. That does not automatically make a direct estate sale or a later sale by an heir exempt; the actual instrument controls. See the Department of Revenue's guidance on deeds of distribution.
