Mortgage foreclosure
Arkansas permits nonjudicial sales under its Statutory Foreclosure Act. Before a nonjudicial sale, the trustee or lender must record the required notice of default, provide and publish the required notices, and wait through the statutory minimum notice period. A judicial foreclosure follows a court case and can carry a post-sale redemption right unless it was validly waived.
