Mortgage foreclosure
Oklahoma has judicial foreclosure and a power-of-sale process when the mortgage grants that power. In a power-of-sale case, the mortgagee must send a notice of intent; the law generally gives the borrower 35 days to cure, followed by a separate sale notice generally served and published at least 30 days before sale. A homestead borrower may elect judicial foreclosure by giving timely notice at least 10 days before the power-of-sale auction. For a judicial foreclosure, the court's schedule sets the dates.
If the sale is postponed, confirm the new date in writing. See Oklahoma Statutes, Title 46, §§46-43 through 46-47.
