Who pays closing costs and documentary transfer tax?

Can a house still be sold if a California trustee’s sale is scheduled?
Often, yes, but the dates matter. Most California home-loan foreclosures are nonjudicial, meaning the deed-of-trust trustee handles the sale without a lawsuit. After a notice of default is recorded, a 90-day cure period runs before a notice of sale may follow. The notice of sale must be posted, published, and recorded at least 20 days before the sale. You can usually reinstate the loan by catching up until five business days before the sale, or pay it off up to the sale itself. There is no right of redemption after a nonjudicial trustee’s sale. A trustee may postpone a sale at the lender’s instruction or by agreement; state law also allows limited 45-day postponements for qualifying 1–4 unit homes tied to a broker listing and a qualifying purchase agreement.
