Who needs to sign?
Ask the title company handling the closing to review the deed, ownership records, and any estate, trust, or court papers and confirm who needs to sign. Texas real-estate transfer tax and closing costs
Texas has no state, county, or city real-estate transfer tax. A deed is signed before a notary and recorded with the county clerk. Recording fees are charged by the page, not by the sale price; the fee can be higher if the deed leaves out the buyer's mailing address. Ask the clerk for the current fee for the property's county.
When you sell to us, we pay the closing costs. Your mortgage, liens, back taxes, and share of current property taxes are separate.

If a trustee's sale is scheduled
A Texas lender usually forecloses without going to court. For a home used as your residence, the loan servicer must first send a written default notice by certified mail and give you at least 20 days to catch up before a sale can be noticed. At least 21 days before the sale, the sale notice must be posted at the courthouse, filed with the county clerk, and sent by certified mail to each borrower.
The public auction is usually on the first Tuesday of the month between 10 a.m. and 4 p.m. It must start no later than three hours after the time stated in the notice. Some foreclosures go through court and follow different steps. Check the actual notices and sale date with your lender, attorney, or title company. If a trustee's sale is scheduled, tell us the date right away so we can try to close before it.

Selling a tenant-occupied house
A sale does not cancel the lease; the buyer becomes the new landlord. Before signing, gather each lease and deposit record and agree in writing how they will be handled at closing. Ask the title company or a Texas attorney to review the lease and proposed arrangement for this property.
For a month-to-month tenancy with monthly rent, either side can end it by notice; it ends on the later of the date in the notice or one month after notice is given. A lease signed by both sides can set a different notice period. Gather each lease and deposit record, and check the actual lease and notices before making a plan.
