Often, yes, if your sale closes and pays off the loan before the foreclosure sale. Virginia home foreclosures are usually trustee's sales under a deed of trust: the trustee auctions the house without a court case. For an owner-occupied home, written notice of the sale generally must go to the owner at least 60 days ahead, or 14 days for other property, and the sale must be advertised in a local newspaper. Plan to close and pay off the loan before the trustee's sale; do not count on buying the house back afterward. The trustee can postpone a sale, and a postponed sale must be advertised again. Do not assume the sale date has moved; have the title company or an attorney confirm the current date and payoff amount. Our agreement of sale will often get a trustee's sale postponed so we can close. Signing alone doesn't postpone it automatically; we use the agreement to ask for the postponement, and it works more often than people think.
