Estate sales and property transfer tax

An inherited house needs probate-court authorization to sell

Often, yes, an inherited Vermont house can be sold before the estate is finished once the probate court authorizes the estate sale. The executor or administrator needs a court license to sell estate real property.

A power to sell in the will can let the court issue that license without the usual notice and hearing, but it does not remove the license requirement. The statute has an exception to that shortcut when the house is occupied by a surviving spouse or a beneficiary listed in the statute.

The closing attorney confirms the license and who must sign. If you need an estate attorney, we can help you find one.

Vermont property transfer tax depends on the buyer’s use

The general property transfer tax is 1.25%, plus a 0.22% Clean Water Surcharge, for a total of 1.47%. A house fit for year-round living that is neither the buyer’s principal residence nor a qualifying long-term rental has a higher total rate of 3.62%. Principal residences and exempt transfers have different treatment. The closing attorney will apply the right category; ask which buyer-use category applies to your sale.

When you sell to us, we pay the closing costs, including Vermont’s property transfer tax and Clean Water Surcharge. Your mortgage, liens, back taxes and share of current property taxes are separate.
