South Dakota allows foreclosure by court action or by advertisement when the mortgage includes a power of sale. For an advertisement sale, publication must run at least weekly for four successive weeks, and the borrower and affected lienholders must receive written notice at least 21 days before the auction. The borrower may require foreclosure by court action after advertisement begins. The sheriff holds the auction in the county where the house is located. The ordinary redemption period is one year after sale; a mortgage with the statutory 180-day clause can shorten it, including to 60 days if the property is abandoned (SDCL §§21-47-13, -14, -23; 21-48-1, -6, -6.1, -9, -10, -11; 21-49-12, -38; 21-52-11). Call us as soon as you receive a sale notice.
