Texas tenant rights, notice, possession, and security deposits

A sale does not by itself cancel a lease. If the lease continues, the buyer becomes the new landlord. Selling the house does not by itself give the seller possession or set a tenant's move-out date; the lease and applicable possession process still matter.

A monthly month-to-month tenancy can be ended with notice

If rent is paid monthly and the tenancy is month to month, either side can end it with notice. Texas Property Code section 91.001 says it ends on the later of the date in the notice or one month after notice is given. A lease signed by both sides can set a different notice period. This rule concerns ending that tenancy; a sale alone does not end the lease.

The lease and possession are separate from the sale

You can sell while tenants are still in the house. The sale itself does not require them to move or cancel the lease. If you want a vacant handoff, the lease, required notice, and applicable possession process still matter; a sale is not an eviction.

Security deposits need a written handoff

From the day the new owner gets title, Texas law makes that owner responsible for returning the security deposit. The new owner must give each tenant a signed statement saying the property has been bought, the new owner is responsible for the deposit, and the exact dollar amount.
