Helpful Maryland rules

Estate authority and selling costs

The personal representative usually signs for an estate sale

The personal representative appointed in the probate case — the executor named in the will or an administrator — usually signs for an inherited-house sale, not the heirs. Maryland law gives the representative legal title to manage and distribute estate property. Unless the will or a court order limits that authority, the representative can sell estate property without court approval. If the will limits a sale or family members disagree, the representative can ask the court for permission.

If you need an estate attorney, we can help you find one.

Maryland transfer and recordation taxes

Maryland’s state transfer tax is 0.5% of the sale price. Howard County sets its recordation-tax rate, and a county transfer tax may also apply. State law generally presumes the buyer and seller split these taxes unless the contract says otherwise.

When the buyer is a first-time Maryland home buyer who will live in the house, the state rate is 0.25%, and the seller pays the state transfer, recordation and local transfer taxes unless the parties expressly agree otherwise. Some transfers are exempt, so ask the settlement company which rules apply to your sale.

When you sell to us, we pay the closing costs, including Maryland's state transfer tax, recordation tax and any applicable county transfer tax.

No agent commissions when you sell to us. No fees.
