Who can sign?
A court appoints a personal representative—an executor or administrator—to act for the estate under KRS 395.015. If the will gives that person power to sell real estate, they can usually sell without a separate court order. If it does not, the representative can ask the District Court for an order granting that power, with notice to everyone who has an interest in the house. The order must be final and the time to appeal must expire before the house can be conveyed; a certified copy is recorded with the deed under KRS 389A.010 and KRS 389A.015. See also the representative’s listed powers in KRS 395.195(6).
A surviving spouse may have rights in the house even if not named on the deed. Kentucky’s surviving-spouse rules changed effective July 15, 2026; see KRS 392.020.
Some heirs may owe Kentucky inheritance tax, though close family is exempt. Read the Kentucky Department of Revenue inheritance-tax information.
Kentucky real estate transfer tax
For a taxable transfer, the Kentucky real estate transfer tax is 50 cents for each $500 of value or fraction of $500. State law assigns it to the grantor—the seller—and the County Clerk collects it before the deed can be recorded. Some transfers are exempt, and deed-recording fees are separate. See KRS 142.050.
Your mortgage payoff, liens, back taxes, and share of current property taxes remain separate settlement amounts.
When you sell to us, we pay the closing costs, including the Kentucky real estate transfer tax. No agent commissions when you sell to us. No fees.

Questions about selling an inherited Florence house
Who can sign for an inherited house in Kentucky?
A court-appointed personal representative—an executor or administrator—acts for the estate. If the will gives that person power to sell real estate, they can usually sell without a separate court order. Otherwise, the representative can ask the District Court for an order granting that power.
Can an inherited Kentucky house be sold before probate is finished?
It may be sold before the estate is finished. The court must first appoint a personal representative. If the will does not give that person power to sell real estate, a District Court order is needed; the order must be final and the time to appeal must expire before the house can be conveyed.
Do I need to put the inherited house in my own name first?
You can sell in the estate's name once the estate is opened — no need to put the house in your own name first. If you need an estate attorney, we can help you find one.
Could a surviving spouse have rights in the house?
Yes. A surviving spouse may have rights in the house even if not named on the deed. Kentucky’s surviving-spouse rules changed effective July 15, 2026.
Could an heir owe Kentucky inheritance tax?
Some heirs may owe Kentucky inheritance tax, though close family is exempt. The Kentucky Department of Revenue explains the state’s inheritance-tax rules.
