Georgia sale rules

Estate authority and real-estate transfer tax

Who can sign for an inherited house?

A Georgia personal representative may sell estate real property before probate closes when the will grants a power of sale or the Probate Court grants authority under O.C.G.A. §53-8-13. Without authority in the will, the personal representative must ask the Court for leave to sell; being an heir or named executor alone is not enough to sign. The will, appointment, court order, and title record determine who may convey.

The Jones County Probate Court handles local estate matters. If you need an estate attorney, we can help you find one.

Georgia real-estate transfer tax

Georgia charges $1 for the first $1,000 of sale price or fraction, then 10 cents for each additional $100 or fraction. The seller is legally liable, although the sales contract can assign payment to the buyer. Some statutory exemptions may apply, and the deed generally cannot be recorded until the tax is paid.

When you sell to us, we pay the closing costs, including Georgia real-estate transfer tax. Your mortgage, liens, back taxes, and share of current property taxes are separate. The closing company can show how the tax and payment responsibility apply to your transaction.
