What deed-recording and closing costs apply in Louisiana?

The parish clerk charges to record a deed. The basic statutory fee is $100 for a document of one to five pages; longer documents, extra indexed names, and other services can add charges. Title and settlement costs also depend on the closing. When you sell to us, we pay the closing costs. Your mortgage, liens, back taxes and share of current property taxes are separate.

Can I sell a Houma house if a sheriff’s sale is scheduled?

Often, yes, if you close before the sheriff's sale and the closing pays the debts and charges needed to clear the title. Louisiana mortgage foreclosures use a court proceeding, either ordinary process or executory process. The lender's payoff can include interest, attorney fees, and court costs as well as the loan balance. The sheriff must serve you a notice of seizure. Can I sell an inherited house before the Louisiana succession is finished?

Often, yes, through the person appointed to handle the estate. In an ordinary estate administration, the representative can sign an agreement subject to court approval of the private sale. An independent administrator can generally sell without a separate court application, subject to the succession papers and Louisiana's rules. Being named in a will is not the same as having the court's authority to sign. The closing attorney can confirm the representative's appointment, any restrictions, and who owns the house. Can I sell a Louisiana rental with tenants still living there?

Yes. Have the leases and deposit records ready so the closing attorney can arrange the transfer correctly. Selling does not, by itself, end the agreement between landlord and tenant. A recorded lease can bind a buyer, but the buyer does not automatically assume all of the seller’s personal lease obligations. Those rights and obligations need to be addressed at closing. If you plan to end a month-to-month tenancy, Louisiana’s basic notice rule is at least ten calendar days before the end of the month; for a residential house, that notice must be in writing. The lease and any other applicable protections can affect the answer.

Can I sell a Louisiana house with a code violation or open order?

Often, yes, but an open order or lien still needs to be dealt with. A parish or city can order an unsafe building repaired or demolished after required notice and a hearing. A condemnation notice recorded in the mortgage records can bind the next owner. If the government does demolition or maintenance work, the costs can become a lien and the owner can remain personally liable. Selling does not erase those charges or orders, so have the notices ready for the closing attorney.

The Terrebonne Parish Clerk of Court’s Civil Records Department maintains civil and probate records, and the Clerk’s Recording and Conveyance/Copy departments handle recorded-document questions. The office is at 7856 Main Street in Houma. Those are records routes; they do not determine the proper court for a particular succession, who may sign, or the title status of a property.
