Can I Sell My Missoula House in Foreclosure?

Our agreement of sale will often get a trustee's sale postponed so we can close. Signing alone doesn't postpone it automatically; we use the agreement to ask for the postponement, and it works more often than people think.

Often, yes, if the sale can close before the foreclosure sale. Many home loans on 40 acres or less use a trust indenture, which lets the lender use a trustee's sale without first going to court. A lender can also foreclose in court; that is a different process. The notice, sale date, payoff, title, and case status determine which steps apply to your house.

How we help you work toward closing

We review the Missoula house as it is, the notice and sale date, the loan payoff, and any title or lien questions. Before you commit, we give you the offer and terms in writing; closing is through a title company. If a trustee sale is involved, Our agreement of sale will often get a trustee's sale postponed so we can close. Signing alone doesn't postpone it automatically; we use the agreement to ask for the postponement, and it works more often than people think.

We buy houses as-is, in any condition — no repairs, no cleaning, no cleanout required to sell to us. When you sell to us, we pay the closing costs. Mortgage balances, liens, back taxes, and your share of current property taxes are separate amounts to review for closing.

You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront. A sale agreement does not automatically change a tax-sale deadline.

Which sale is involved: mortgage foreclosure or tax sale?

A mortgage foreclosure enforces a home loan. Many home loans secured by 40 acres or less use a trust indenture, so the lender can use a trustee's sale without first filing a court case. The trustee-sale notice must be recorded and mailed at least 120 days before the sale; it must also be published for three weeks and posted on the property at least 20 days before the sale. These are trust-indenture deadlines, not a court-foreclosure or tax-sale timetable. See Montana's trust-indenture and court-foreclosure law, notice deadline and sale procedure.

Before a trustee's sale, you can generally cure a payment default by paying the amount in default plus allowed costs and fees. Principal due only because of acceleration is excluded, but principal already due at maturity must still be paid. Read Montana's cure-before-sale rule.

A property-tax sale concerns unpaid taxes, not the lender enforcing a mortgage or trust indenture. It has a separate notice and deadline. The trustee-sale dates above do not apply to a tax matter; follow the tax notice and contact the office named there. If you have both kinds of notice, keep the dates separate.

Court foreclosure and trustee-sale rights are different

Montana also allows a lender to foreclose in court. There is no redemption after a trustee's sale; an owner after a court foreclosure sale generally has up to one year to redeem. The notice and court record for your property control. Read the state laws on redemption after a mortgage sale, redemption after a court sale and the trustee's deed after a trustee sale.

If the payoff is the problem

Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.

Ask the lender for a current payoff statement. The amount needed to close depends on that figure, title, and any other liens on the property.

What happens next

  1. Call or send the Missoula property address and the notice, case number, or sale date you have.
  2. We review the house as-is and give you written offer terms before you commit.
  3. If you choose to proceed, a title company reviews title, mortgage payoff, liens, and tax amounts while we work toward closing.
  4. If a trustee sale is involved, we use the agreement to ask for postponement. Confirm the current date and any change with the trustee named in your notice.

It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.

Questions about selling before foreclosure in Missoula, MT

Can I sell my Missoula house before a trustee's sale?

Often, yes, if the sale can close before the foreclosure sale. Our agreement of sale will often get a trustee's sale postponed so we can close. Signing alone doesn't postpone it automatically; we use the agreement to ask for the postponement, and it works more often than people think. Check the current sale date with the trustee named in your notice.

How is a trustee sale different from a court foreclosure in Montana?

Many home loans on 40 acres or less use a trust indenture, which can let the lender hold a trustee sale without first filing a court foreclosure. A lender can also foreclose in court. These are different processes: there is no redemption after a trustee sale, while an owner in a court foreclosure generally has up to one year after the sale to redeem. Check the notice and court record for your property.

Is a mortgage foreclosure the same as a Missoula County tax sale?

No. A mortgage foreclosure is about a home loan; a tax sale concerns unpaid property taxes. They have separate notices and deadlines. The Montana trustee-sale deadlines on this page do not set a tax-sale deadline. Follow the tax notice and check Missoula County’s delinquent-tax information.

What if the payoff is more than my Missoula house is worth?

Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before. The current payoff and title details determine what amounts need to be addressed at closing.

Do I have to pay back taxes before selling to you?

You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront. A tax-sale notice has its own deadline, so keep that date separate and follow the notice.
