How we help you work toward closing

If a master commissioner's sale is scheduled, tell us the date right away so we can try to close before it. Send us the property address, too. We review the house as-is and give you written offer terms before you decide whether to sign. If you choose to move ahead, a title company reviews ownership, payoff figures, liens, and closing requirements.

A mortgage foreclosure and a property-tax sale are different

A Kentucky mortgage foreclosure goes through circuit court. The lender files a lawsuit; if it wins a judgment, the court orders a public auction run by a master commissioner. A property-tax sale has its own notices and deadlines; use the date on that notice, not the mortgage-case schedule.

For a mortgage case, the master commissioner generally holds the sale within 90 days after the case is referred. Two disinterested people appraise the house first, and the sale is advertised at least once, 7 to 21 days before the auction. The court must confirm the sale before the buyer receives a deed. The 90 days start with referral of the case, not with a missed payment, so the dates in your court papers matter.

If the auction price is less than two-thirds of the appraisal, Kentucky law lets the owner redeem within six months by repaying the sale price plus 10% interest and certain costs. See KRS 426.530 on redemption, KRS 426.560 on judicial-sale advertising, and Kentucky Supreme Court Order 2024-40, master commissioner sale rules.

If the payoff is the problem

Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.

The title company can review the current mortgage payoff, liens, and other amounts due as part of the closing work. Those figures help show what a sale would need to cover.

What happens next

  1. Contact us. Call or send the Murray property address and the date shown on your court papers.
  2. Review written terms. We look at the house as-is and give you a written offer and terms before you commit.
  3. Check title and payoff. If you choose to proceed, a title company reviews ownership, the current payoff, liens, and the requirements for closing.
  4. Work toward closing. We work with you and the title company toward closing if the payoff, title, and court timing allow the sale to proceed. When you sell to us, we pay the closing costs, including the Kentucky real estate transfer tax. Mortgage payoffs, liens, back taxes, and your share of current property taxes are separate settlement items.

It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.
