Who can sign

In Michigan, being named in a will is not enough by itself to sign for an estate. A personal representative’s duties and powers begin on appointment. Ask for current certified Letters of Authority from the actual probate file; check the letters, will, any limits or orders, and title requirements together. The statewide PC 572 Letters of Authority form includes fields for real-estate restrictions and expiration.

Michigan’s default rules give an appointed personal representative power to dispose of estate property, including land, subject to restrictions in the law and estate file. Court approval is not required for every personal-representative sale. A state or county public administrator may not sell a decedent’s real property without court approval. The controlling provisions are in the state’s Estates and Protected Individuals Code (including MCL 700.3701 and 700.3715).

For a decedent who lived in Michigan, the first probate appointment or will proceeding ordinarily follows the county where the person was domiciled at death. Transfer taxes and recording charges

Muskegon County’s published schedule says a transfer valued at $100 or more requires state and county real-estate transfer tax: $0.55 per $500 or fraction for the county and $3.75 per $500 or fraction for the state.
