Newport, TN / Foreclosure
Can I Sell My Newport House Before Foreclosure?
If a trustee's sale is scheduled, tell us the date right away so we can try to close before it. Often, yes: you can sell a Tennessee home in foreclosure if the sale closes before the scheduled date. We buy houses as-is in Newport and Cocke County, Tennessee — no repairs, no cleaning, no cleanout required to sell to us.
Call 888-274-5006. We answer 24/7.
A scheduled sale date is time-sensitive. An offer does not change that date; the payoff, title work, and closing must be completed in time.
How we work toward closing
We review the house and the sale date, then give you a written offer and written terms before you decide. If you accept, we close through a title company and work through the title and payoff details with them so there is a clear settlement plan.
When you sell to us, we pay the closing costs, including Tennessee's realty transfer tax. Your mortgage payoff, liens, back taxes, and share of current property taxes are separate from those closing costs and remain part of the settlement figures.
Mortgage foreclosure or property-tax sale?
A lender's trustee sale under a deed of trust is different from a sale arising from unpaid property taxes. The tax case has its own notice and deadline; the mortgage-sale dates below do not set a tax-sale deadline. Check the notice to identify which process and date apply to your property.
Tennessee trustee-sale notices and dates
Many Tennessee home loans use a deed of trust. If it gives the trustee a power of sale, the trustee can auction the home publicly without first filing a court case. Under the usual notice rules in effect since July 1, 2025, the notice must run at least twice in a newspaper published in the county, with the first notice at least 20 days before the sale. It must also be posted online by a third-party internet posting company for at least 20 consecutive days. The trustee must mail you a copy by registered or certified mail by the date of the first newspaper notice. See Tennessee's current foreclosure-notice law.
If the sale date changes
Unless the loan papers prohibit it, a trustee may postpone the sale without a new newspaper notice, but the sale must still happen within one year of its original date. The new date must be announced at the scheduled sale and posted online unless the delay is less than five days. If the sale is postponed more than 30 days, the new date, time, and place must be mailed at least 10 days before the sale. Check the latest notice and ask about the date that applies to your case; a court-ordered sale follows different rules.
If a deed-of-trust or mortgage sale happens without a court judgment, Tennessee law provides a two-year right to redeem unless the loan document expressly waives it (Tenn. Code Ann. § 66-8-101). Court-ordered sales have different rules.
If the payoff is the problem
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.
What happens next
- Tell us the scheduled sale date and what is happening with the property.
- We review the house and provide written offer terms before you commit.
- If you choose to sell to us, we work with the title company to confirm title, payoff figures, and the closing details.
- The title company handles the settlement. Whether a sale can close before the scheduled date depends on the actual payoff, title, and timing.
It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.
