Can I Sell My Sandpoint House in Foreclosure?

If a trustee's sale is scheduled, tell us the date right away so we can try to close before it.

Often, yes: you can sell before the trustee's sale. A lender can foreclose on a deed of trust through a trustee's sale without going to court, or foreclose through a court case. We can look at your notice and work with you toward a sale before the date.

We’re USA Home Buyers. We buy houses as-is in Sandpoint and Bonner County, in any condition — no repairs, no cleaning, no cleanout required to sell to us.

A direct option

How we help with a Sandpoint foreclosure sale

We review the house as-is and give you a written cash offer and written terms before you commit. If you choose to sell to us, we close through a title company. We work with you and the title company on title and payoff details as we move toward closing.

Separate notices, separate deadlines

Idaho mortgage foreclosure and a county tax sale are different

A mortgage foreclosure concerns the home loan. With a deed of trust, a lender can use a trustee-sale process outside court; Idaho also allows a court foreclosure. A tax-deed or tax-sale matter concerns county property taxes and goes through a separate county process. Do not apply a mortgage-foreclosure date to a tax-sale notice. Bonner County’s Treasurer is the county contact for property-tax collection and its tax-deed/sale information.

For a deed-of-trust foreclosure, the trustee’s sale cannot happen until at least 120 days after the notice of sale is mailed. The notice must also be published once a week for four weeks, with the last publication at least 30 days before the sale; the trustee must try to serve an adult occupant and post the notice. The notice of default is recorded with the county and mailed to you.

You can usually reinstate within 115 days after the notice of default is recorded by paying the overdue amount and allowed costs and fees. Principal that would not be due without the default is excluded, but any amount already due still has to be paid.

If a regulated lender’s loan is for your main home and the property has a homeowner’s exemption, a loan-change request form comes with the notice of default. If the lender receives it within 30 days, the sale cannot happen until the lender answers. A trustee may postpone a sale at the lender’s request by announcing it at the sale; each postponement can be no more than 30 days and may be repeated. For covered primary-home loans from a regulated lender, the trustee must mail at least 14 days’ notice before a postponed sale.

After a trustee’s sale, there is no right to buy the house back. If the lender instead forecloses in court, the owner can generally redeem after the sale within six months, or one year if the land is more than 20 acres. These court-sale redemption periods are different from the trustee-sale deadlines above.

If the payoff is the problem

What if the lender payoff is more than the house is worth?

Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.

We can work with the title company to review the payoff and any other liens against the written sale terms.

What happens next

From your notice to a title-company closing

  1. Call or send the property address and the notice you received. If a trustee’s sale is scheduled, tell us the date right away.
  2. We review the house as-is and give you a written cash offer and written terms before you decide whether to commit.
  3. If you choose to proceed, the title company reviews title, payoff, tax, and lien details as part of preparing for closing.
  4. We stay in touch with you and work toward closing before the scheduled sale date.

When you sell to us, we pay the closing costs. Your mortgage, liens, back taxes and share of current property taxes are separate.

It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.

Sandpoint foreclosure questions

Can I sell my Sandpoint house before a trustee sale?

Often, yes, if you close before the trustee's sale. If you sign a sale contract during a trustee-sale foreclosure, Idaho requires a notice in the contract and gives you five business days to cancel. No money or interest in the house can change hands until those five business days have passed. Tell us the scheduled date right away so we can try to close before it.

How long is the Idaho trustee-sale timeline?

For a deed-of-trust foreclosure, the trustee’s sale cannot happen until at least 120 days after the notice of sale is mailed. You can usually reinstate within 115 days after the notice of default is recorded by paying the overdue amount and allowed costs and fees. A court foreclosure follows a different process.

Is a mortgage foreclosure the same as a Bonner County tax sale?

No. A mortgage foreclosure concerns the home loan and may use a deed-of-trust trustee sale or a court case. A tax-deed or tax-sale matter concerns county property taxes and follows a separate notice and deadline path. Bonner County’s Treasurer handles property-tax collection and the county’s tax-deed and sale information.
