Who can sign for an inherited house?
An executor or administrator appointed by Surrogate’s Court can generally sell estate property during administration, subject to the will and court restrictions. A house the will leaves to a specific person is outside that power, so the sale usually needs that person’s agreement or a court order. Some court papers also bar a sale without court approval, and a release of the state estate-tax lien is generally needed to close. Being named executor in a will is not the same as court appointment. The deed and estate papers determine who can sign.

Mortgage foreclosure and a sale date
A sale may still be possible before the New York foreclosure auction if the mortgage payoff and other closing obligations can be covered. New York foreclosures go through court, and a referee conducts the sale. After the auction, there is no right to buy the house back. If you live in the house and are in foreclosure or two or more months behind, New York’s Home Equity Theft Prevention Act gives you 14 business days to cancel a sale to an investor. Stopping foreclosure by paying the lender requires the full amount owed, including applicable interest, fees, and costs.
Our agreement of sale will often get a foreclosure sale postponed so we can close. It doesn't always work, but it works more often than people think.

New York transfer taxes and closing costs
When the sale price exceeds $500, New York State real estate transfer tax is $2 for each $500 of price, or part of $500. That is $400 on a $100,000 sale before any local tax or exemption. The seller normally pays this base tax, but the sale agreement can provide otherwise; local transfer taxes may add. A separate 1% mansion tax normally applies to residential sales of $1 million or more and is normally paid by the buyer.
When you sell to us, we pay the closing costs, including New York State real estate transfer tax and any applicable local real estate transfer taxes. Your mortgage, liens, back taxes, and share of current property taxes are separate.

Tenants and Jamestown rental registration
An ordinary New York sale generally leaves the existing lease and tenant protections in place, and the buyer becomes the landlord. A sale alone does not require tenants to move. If a tenancy can lawfully end, advance notice can be 30, 60, or 90 days depending on the tenant’s occupancy and lease term; other protections can apply. Bring the lease, deposits, and notices into the closing discussion.
For properties inside Jamestown, the City Clerk describes registration for recorded owners of residential rental units or rooms, an annual filing date, and an additional filing trigger after a transfer. Confirm whether the property and any listed exception apply with the Clerk.

A City notice or County tax-foreclosure question
Jamestown Code Enforcement investigates complaints, inspects reported conditions, and may issue a notice of violation or an appearance ticket. Ask the City about the actual notice, address, and stated deadline; an as-is sale does not itself clear an order. Chautauqua County’s foreclosure page provides post-auction surplus information, not a determination of a property’s foreclosure, payoff, auction, or surplus status. Use the actual court or tax notice to check the case and dates.
