If a trustee's sale is scheduled
A sale may still be possible if the loan can be paid off before the auction. For a loan secured by a deed of trust, a trustee can sell the property at public auction after default without a court case. Notice generally must be published in the property's county once a week for two consecutive weeks; the trustee must also send the borrower notice by certified mail, return receipt requested. Notice counts once mailed to the required address, even if it comes back. A narrow exception applies to an older deed of trust. Treat the auction date as the deadline for completing a sale and payoff; ask the title company or an attorney to confirm the current date and amount due.
Our agreement of sale will often get a trustee's sale postponed so we can close. Signing alone doesn't postpone it automatically; we use the agreement to ask for the postponement, and it works more often than people think.
