Atlantic City, NJ / Foreclosure

Can I sell my Atlantic City house before foreclosure?

If a foreclosure sale is scheduled, tell us the date right away so we can try to close before it.

Yes. You may be able to sell before the Atlantic County Sheriff’s sale if the mortgage payoff, title work, and closing can be completed in time. The right next step depends on the court case, the notices you received, and the current sale date.

How we help you work toward closing

We review the house as-is and give you a written offer and written terms before you commit. If you choose to sell, a title company checks title and current payoff information as we work toward a closing before the scheduled sale, when the timing and case allow.

You do not need to make repairs, clean, or clear out the house to sell to us. When you sell to us, we pay the closing costs, including New Jersey's realty transfer fee and any applicable graduated percent fee. Your mortgage payoff, liens, back taxes, and your share of current property taxes are separate from that promise.

Mortgage foreclosure or tax sale?

This page explains a lender’s mortgage foreclosure in New Jersey. It goes through the courts and can lead to a sheriff’s sale. A sale notice for unpaid property taxes is a different process with its own notices and dates. Read the notice you received and contact the office named there; do not use mortgage-foreclosure deadlines for a tax sale.

New Jersey mortgage-foreclosure steps

  1. Before filing a foreclosure complaint, the lender sends a Notice of Intention to Foreclose. You then have 30 days to catch up on the debt or ask for mediation before the lender can file in court.
  2. After you are served with the complaint, you have 35 days to answer. If you do not answer or contest the case, it may proceed as uncontested. In an uncontested residential case, the lender normally must give at least 14 calendar days’ notice before submitting proofs for final judgment, explaining how to get the amount needed to catch up.
  3. After final judgment, the sheriff can sell the house at a public auction called a sheriff’s sale. The sale must be advertised for at least four weeks, and the sheriff has 150 days from the writ of execution to hold it.
  4. You can ask the sheriff for two postponements, each up to 30 calendar days. The lender can get two as well; one more is allowed if both sides agree, and a court can order more for good cause.
  5. After the sale, you generally have 10 days to redeem the house by paying the full amount due, including the judgment and sale costs. This is after the auction, not extra time before it.

These steps do not make one countdown for every property. Check the dates in your notices and court papers. Free foreclosure mediation is available through the New Jersey Courts.

If the payoff is the problem

Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.

Ask the lender for a current payoff. The title company can review it with recorded liens and the other amounts tied to the property. Any lender decision about a reduced payoff depends on that transaction.

What happens next

  1. Tell us the property address and what your notice says. Call or use the form above.
  2. We review the house and give you a written offer and written terms before you commit.
  3. The title company reviews title and payoff details with the parties involved.
  4. We work toward a title-company closing before the scheduled sale when the payoff, title, case status, and timing allow.

It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.

Questions about foreclosure in Atlantic City, NJ

Can I sell my Atlantic City house before a sheriff’s sale?

If a foreclosure sale is scheduled, tell us the date right away so we can try to close before it. A sale may still be possible if the payoff, title work, and closing can be completed before the current sale date.

What deadlines apply to a New Jersey mortgage foreclosure?

The first notice generally gives you 30 days to catch up or ask for mediation before the lender files in court. After service of the complaint, you have 35 days to answer. Final-judgment, sheriff-sale, postponement, and redemption dates are later steps; check your court papers and notices for the dates that apply to your case.

Is a mortgage foreclosure the same as a property-tax sale?

No. A lender’s mortgage foreclosure goes through the courts and can lead to a sheriff’s sale. A sale over unpaid property taxes is a separate process with different notices and deadlines. Follow the tax-sale notice and contact the office named there; do not use mortgage-foreclosure deadlines to calculate a tax-sale date.

Is free foreclosure mediation available in New Jersey?

Yes. Free foreclosure mediation is available through the New Jersey Courts. The court’s foreclosure information explains how to ask for mediation and how to use the dates in your case notices.

What if my mortgage payoff is more than my house is worth?

Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before. Ask the lender for a current payoff so the title company can review the amount needed for closing.
