Can I Sell My Hailey House Before Foreclosure?
If a trustee's sale is scheduled, tell us the date right away so we can try to close before it.
Often, yes. If a lender forecloses on a loan secured by a deed of trust, the lender can hold a trustee’s sale without going to court. A lender can also choose a court case. A sale may be possible before the trustee’s sale if the payoff, title work, and time available allow a closing.

How we help
We review the Hailey house as-is and give you a written offer and written terms before you commit. If you choose to move ahead, the closing goes through a title company. The title company reviews title, payoff figures, liens, and the documents needed for closing.
You do not need to pay off back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront.
When you sell to us, we pay the closing costs. Your mortgage, liens, back taxes and share of current property taxes are separate.
Which sale is on your notice?
The mortgage deadlines below apply to a lender’s foreclosure, not a Blaine County property-tax sale. Idaho permits a deed-of-trust foreclosure without a court case, or the lender may choose to foreclose in court. A tax-sale notice has its own process and dates; follow that notice and contact the county office handling the tax account.
Deed-of-trust notice and trustee-sale dates
The process starts when a notice of default is recorded with the county and mailed to you. A trustee’s sale cannot happen until at least 120 days after the notice of sale is mailed. The sale notice must also be published once a week for four weeks, with the last publication at least 30 days before the sale; the trustee must try to serve an adult occupant and post the notice. See Idaho Code § 45-1505 and § 45-1506.
Time to reinstate or request a loan change
Within 115 days after the notice of default is recorded, you can usually reinstate by paying the overdue amount and allowed costs and fees. Principal that would not otherwise be due is excluded, but any amount already due still has to be paid. See Idaho Code § 45-1506.
For a covered loan from a regulated lender when the house is your main home and has a homeowner’s exemption, a loan-change request form comes with the notice of default. If the lender receives it within 30 days, the sale cannot happen until the lender answers. See Idaho Code § 45-1506C.
Postponements and rights after a sale
If the lender asks, a trustee can postpone the sale by announcing it at the sale. Each postponement can be no more than 30 days, but postponements can be repeated. For covered primary-home loans from a regulated lender, the trustee must mail at least 14 days’ notice before holding a postponed sale. After a trustee’s sale, there is no right to redeem the house. After a court sale, the owner can generally redeem within six months, or one year if the land is more than 20 acres. See Idaho Code § 45-1506, § 45-1508, and § 11-402.
A sale contract during a trustee foreclosure
If you sign a contract to sell during a trustee-sale foreclosure, Idaho law requires a notice in the contract and gives you five business days to cancel. No money or interest in the house can change hands until those five business days pass. See Idaho Code § 45-1602 and § 45-1603.
If the payoff is the problem
Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.
A current lender payoff, title, liens, back taxes, and your share of current property taxes are separate figures. If you choose to sell, the title company reviews the amounts needed for closing.
What happens next
- Contact us with the property and notice date. Call or use the form with the Hailey address and any trustee-sale or court date you have.
- Review the written offer and terms. We review the house as-is and give you written terms before you commit.
- Work through title and payoff details. If you choose to move forward, a title company reviews ownership, payoff figures, liens, and the documents needed for closing.
- Close if the requirements and timing fit. The title company handles closing. When you sell to us, we pay the closing costs. Your mortgage, liens, back taxes and share of current property taxes are separate.
It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.

Foreclosure questions for Hailey and Blaine County
Can I sell my Hailey house before a trustee's sale?
Often, yes, if the title and payoff work can be completed before the sale. If a trustee's sale is scheduled, tell us the date right away so we can try to close before it. The notice and current trustee information control the date.
How much notice is required before an Idaho trustee sale?
For an Idaho deed-of-trust foreclosure, a trustee’s sale cannot happen until at least 120 days after the notice of sale is mailed. The notice must also be published once a week for four weeks, with the last publication at least 30 days before the sale, and the trustee must try to serve an adult occupant and post the notice.

Is a property-tax sale the same as a mortgage foreclosure?
No. A lender’s mortgage foreclosure and a county property-tax sale are separate processes with separate notices and deadlines. If your notice concerns unpaid property taxes, follow that notice and contact the county office handling the tax account; do not apply mortgage-foreclosure dates to it.
Can I get the house back after an Idaho foreclosure sale?
After an Idaho trustee’s sale, there is no right to redeem the house. A court foreclosure follows different rules: the owner can generally redeem within six months after the sale, or one year if the land is more than 20 acres.
Can I cancel a sale contract during a trustee-sale foreclosure?
Idaho law requires a notice in a contract to sell during a trustee-sale foreclosure and gives you five business days to cancel. No money or interest in the house can change hands until those five business days pass.
