Can I sell my Newport house in foreclosure?

If a foreclosure sale is scheduled, tell us the date right away so we can try to close before it.

Yes, you may still be able to sell before a scheduled foreclosure sale if the closing can address the mortgage payoff and other claims in time. Rhode Island lenders can foreclose through a court case or use a power-of-sale clause in the mortgage.

How we help you work toward closing

We look at the house as it stands and review the sale notice, payoff, and title details with you. We buy houses as-is, in any condition — no repairs, no cleaning, no cleanout required to sell to us.

You get a written offer and written terms before you commit, and we close through a title company.

No agent commissions when you sell to us. No fees.

Mortgage foreclosure and Newport tax-lien sales are different

A mortgage foreclosure concerns the home loan. Rhode Island lenders can use the court process or a power-of-sale clause in the mortgage. Newport’s property-tax lien sale is separate and concerns unpaid city property taxes.

If your notice is about a Newport property-tax account, the City’s Tax Billing and Collections office can help with the bill or delinquent account. Use the date on that notice; it is a different process from a lender’s mortgage foreclosure.

For a covered first mortgage on an owner-occupied home with 1 to 4 units, the lender normally must take part in a free mediation conference through a Rhode Island HUD-approved housing counseling agency before a power-of-sale foreclosure. Reverse mortgages, defaults on or before May 16, 2013, and other statutory exceptions are excluded. The conference is scheduled within 60 days after the notice is mailed.

Before advertising a power-of-sale auction, the lender mails the owner a notice by certified mail. For a typical homeowner loan, that is at least 30 days before the first newspaper notice. The sale notice then runs once a week for three weeks in a row, starting at least 21 days before the sale. A completed power-of-sale auction ends the owner’s right to redeem the house. Tenants receive their own mailed notice before the sale is advertised.

Read the Rhode Island laws on power-of-sale foreclosures, court foreclosure, mediation, sale notices, and tenant notices.

If the payoff is the problem

Think the payoff is more than the house is worth? Ask us — we've gotten lenders to come down before.

You don't need to pay off your back taxes before we settle. We buy houses with back taxes and liens — payoffs get handled through the closing, not by you upfront.

Your mortgage payoff, liens, back taxes, and share of current property taxes are separate from closing costs. A title company reviews the amounts that have to be handled through the sale.

Rhode Island closing costs

When you sell to us, we pay the closing costs, including Rhode Island's real estate conveyance tax.

What happens next

  1. Call or send the property address and the foreclosure notice or sale date.
  2. We review the house and the payoff information, then give you written terms before you commit.
  3. If you choose to move forward, a title company reviews title and payoff details and coordinates closing.

It's real estate. Sometimes there are bumps in the road. We won't disappear when that happens, and we'll be fighting to get this to the closing table.

Questions about selling a Newport house in foreclosure

Can I sell my Newport house before a foreclosure sale?

Yes. A sale may still be possible if closing can address the mortgage payoff and other claims before the scheduled sale. If a foreclosure sale is scheduled, tell us the date right away so we can try to close before it.

Is Newport’s tax-lien sale the same as a mortgage foreclosure?

No. A mortgage foreclosure concerns the home loan. A Newport property-tax lien sale is a separate process for unpaid city property taxes, with its own notice and date. Contact Newport Tax Billing and Collections about a city tax bill or delinquent account.

Does every Rhode Island homeowner get foreclosure mediation?

No.

Can I redeem my house after a Rhode Island power-of-sale auction?

A completed sale under the statutory power of sale ends the owner’s right to redeem the house. A court foreclosure follows its own court process and deadlines.
