Who pays closing costs and Nevada real property transfer tax?

Nevada's real property transfer tax is due when a taxable deed is recorded and is charged for each $500 of value, or part of $500. By law, buyer and seller are each responsible for the full tax; the contract can say who pays, but the county may collect from either one. The county rate and any exemption affect the amount. When you sell to us, we pay the closing costs, including Nevada's real property transfer tax. Your mortgage, liens, back taxes, and share of current property taxes are separate.

Can I sell my Nevada house while it is in foreclosure?

Often, yes, if the sale closes before the trustee's sale. With a deed-of-trust loan, the trustee can sell the house without a court case. The trustee first records a notice of default and election to sell with the county recorder and mails you a copy. The trustee cannot sell unless the missed payments stay unpaid for 35 days after that. If you live in the home, the notice must include information about foreclosure mediation. You have 30 days after it is served to waive mediation or ask the district court for it; asking costs a $25 filing fee plus your share of the mediator's fee. If you file, pay, and serve the required request on time, the trustee cannot move ahead with the sale until mediation is finished. At least 3 months after the notice of default is recorded, the trustee can give notice of sale. That notice is recorded, mailed or delivered to you, posted in a public place in the county for 20 days, and printed in a county newspaper once a week for 3 weeks. The sale can be postponed by an announcement at the sale. After three spoken postponements, any new sale date needs a new notice. Nevada law gives no right to buy the house back after the trustee's sale. If a trustee's sale is scheduled, tell us the date right away so we can try to close before it.
